Fanslau, Planning Director Date: February 27, 2019 Subject: Final Plat approval of FALLING WATERS NORTH, a subdivision located outside the city limits, with rezoning from AG to R4 South of HWS Cleveland Boulevard and west of 198th Street Case #C10-18-242, C12-18-243 The preliminary plat of Falling Waters North, a subdivision outside the city limits, with rezoning from AG-Agricultural District to R4-Single-family residential district was recommended for approval by the Planning Board at their regular meeting November 7, 2018, and subsequently approved with conditions by the City Council on January 18, 2019. The applicant is proposing to subdivide the 17.66 acre site for the future construction of an elementary school. Primary education facilities are a permitted use in the R4 District. Planning Board and City Council approval of the Preliminary Plat was subject to the following conditions (with subsequent responses for this review included): 1. Contribute to the future creek crossing northwest of the subdivision. (This will be addressed in final approved subdivision agreement.) 2. Remove the outlots from the plat and include those areas in Lot 1. (Applicant has removed outlots and included the area in Lot 1.) 3. Coordinate with Public Works on an acceptable stacking and circulation plan. (The applicant has been in coordination with Public Works regarding the stacking and circulation plan, which will be reviewed at building permit submittal.) 4. Construct public sanitary sewer along the HWS Cleveland right-of-way. (Applicant has been in coordination with Public Works and has demonstrated that the proposed elevation of HWS Cleveland and the accessibility of existing sanitary sewer lines extending north on the west and east edges of the plat that construction of a sanitary sewer along HWS Cleveland Boulevard is not necessary.) 5. Submit a sight distance exhibit for the 201st Street approaches to HWS Cleveland, and revise the boulevard plan to remove any trees from the sight triangles. (The applicant has been in coordination with Public Works regarding this condition.) 6. Construct left turn lanes on HWS Cleveland at 201st Street. (Revised paving plans include left turn lanes on HWS Cleveland at 201st Street and will be included in the final subdivision agreement.) 7. Compliance with all applicable stormwater management ordinances and policies, including providing for a no net increase in stormwater runoff and must treat the first 1/2” FALLING WATERS NORTH Case # C10-18-242, C12-18-243 Page 2 GS of stormwater for water quality. (Condition to be addressed in the final approved subdivision agreement.) 8. Temporary turn-arounds shall be provided at the terminus of all temporary dead-ended streets. (The applicant has been in coordination with Public Works regarding intersection plans, which will be included in the final subdivision agreement.) 9. Coordinate with Douglas County to incorporate traffic calming measures in the design of some of the interior streets. (Applicant has provided plans for a speed table for “Z” Street.) 10. Boulevard plans and cost estimates must be approved by the Parks and Recreation Advisory Board prior to bidding. (Applicant presented plans to the Park Advisory Board on November 1, 2018. Plans and specifications (minimum 60%) must be submitted for review to the Park Board prior to bidding.) 11. Change the label of the “35’ no build zone” to 35’ no-build easement. (The plat labels this as a no-build setback, but will need updated to a 35’ no-build easement. Also, the Parks Department has indicated that the “35’ no-build easement” on the Paving and Boulevard Tree Plan is not aligned correctly with the back of curb and the setback line. The Applicant will need to revise and resubmit plans correctly showing correct alignment.) ANALYSIS: Conditionally, the proposed subdivision is consistent with and carries out the goals and objectives of the City of Omaha Master Plan. Development must comply with all applicable zoning codes including Articles 13 and 14 of the Omaha Zoning Ordinance regarding parking and landscaping. RECOMMENDATION: Approval of the rezoning from AG to R4. Approval of the Final Plat, subject to submittal of an acceptable final subdivision agreement, prior to forwarding the request to the City Council for final action. C10-18-242 C12-18-243 Gretna Public Schools, Dr. Kevin Riley, Superintendent REQUEST: Final Plat approval of FALLING WATERS NORTH, a subdivision outside the city limits, with rezoning from AG to R4 LOCATION: South of HWS Cleveland Boulevard and west of 198th Street At the Planning Board meeting held March 6, 2019, Mr. Eric Englund, Manager of Current Planning, explained that the preliminary plat for had been approved, with conditions, by the Planning Board on November 7, 2018. Subsequently, on January 18, 2019, the preliminary plat was approved, again with conditions, by the City Council. He stated that the applicant is proposing to build an elementary school on the 17.5 acre site, which is a permitted use in R4 zoning. Mr. Englund stated that the department recommends approval of the rezoning from AG to R4 and approval of the final plat subject to the submittal of an acceptable final subdivision agreement prior to forwarding the request to City Council for final approval.
