The attached Resolution approves the Preliminary Plat of ESTATES AT LOVELAND, a
subdivision inside city limits, with a waiver of Section 53-8(2b), Cul-de-sac length. located
southeast of 87th and Pacific Streets. The applicant is Royce Enterprises, Inc.
CASE DESCRIPTION: To subdivide and rezone approximately 7.2 acres into 18 lots for single
family residential development and three outlets for access, drainage and open space purposes.
A rezoning from R2-Single-Family Residential District (Low-Density) to R4-Single-Family
Residential District (High-Density) will accompany the Final Plat.
DEPARTMENT RECOMMENDATION: Approval of the waiver to Section 53-8(2b), Cul-de-sac
length.
Approval of the Preliminary Plat, subject to the following conditions:
1.Revise the plat to include the following:
a)Include the standard vacation language on the plat.
b)Place a note on the plat that there shall be no direct access to Pacific Street from any
lots or outlets, and no direct access to 87th Street from Outlets A or B.
c)Place a note on the plat that Lots 1-18 and Outlets A-C are subject to compliance with
the approved tree mitigation plan included in the final subdivision agreement.
2.Dedicate ROW along Pacific Street as necessary to accommodate the standard
sidewalks.
3.Construct the private street in Outlet C to City standards.
4.Submit the 30 percent design report for the sanitary sewer to the Public Works Design
Division per Section 2.14 of the City's Wastewater Collection Systems Design Manual.
5.Construct the sanitary sewer to City standards, and grant a sewer easement to the City.
6.Provide sidewalks along all street frontages as required by Section 53-9(9), Sidewalks, of
the Omaha Municipal Code.
7� Coordinate any grading, construction or vegetation management plans near the overhead
power lines with OPPD. Coordinate with OPPD on removal/relocation of equipment if
necessary.
8.Compliance with all applicable stormwater management ordinances and policies.
9.Compliance with an acceptable tree mitigation plan.
10.Provide for the use, ownership, and maintenance of the outlots in the final subdivision
agreement.

Purpose: To subdivide and rezone approximately 7.2 acres into 18 lots for single

Applicable Regulations: If approved, development of the site will be subject to
the requirements of the R4 District, as well as all other
applicable regulations.
No building permits will be issued based on a site plan that does not comply with the
provisions of the Zoning Ordinance.
II. SPECIAL INFORMATION:
Site
Characteristics:
The site is comprised of seven platted lots totaling 7.2 acres developed with
single family residential homes on approximately 1 acre lots. The property
slopes uphill from west to east across the site.
Development
Proposal:
The applicant is proposing 18 single family residential lots and three outlots
to be used for open spaces, drainage, and access. Submitted plans show
that “Street A” is designed in excess of the maximum cul-de-sac length
permitted in Chapter 53, Subdivisions and, as such, the applicant has
requested a waiver to cul-de-sac length as a part of this request.
Public

Right-of-Way: Dedicate ROW along Pacific Street as necessary to
accommodate the standard sidewalks.
Street Design: Submitted plans show that the cul-de-sac street exceeds
the maximum length. However, placing a through street connection to
Pacific Street would create an unnecessary conflict with the existing
intersections on Pacific Street. In addition, as designed, the proposed
street may provide for a through-street connection to 81st Street at some
time in the future. The requested waiver to Section 53-8(2b), Cul-de-sac
length, can be supported.
Construct the private street in Outlot C to City standards.
Sanitary Sewers: Submit the 30% design report for the sanitary sewer to
the Public Works Design Division per Section 2.14 of the City’s Wastewater
Collection Systems Design Manual.
Construct the sanitary sewer to City standards, and grant a sewer easement
to the City.
Sidewalks: Provide sidewalks along all street frontages as required by
Section 53-9(9), Sidewalks, of the Omaha Municipal Code.
Subdivision Agreement: Provide for the use, ownership, and maintenance
of the outlots in the final subdivision agreement.
Provide for the maintenance of the Pacific Street sidewalks in the
subdivision agreement.
Utilities: OPPD has a transmission line that runs along the north edge of this
property. OPPD should be contacted to coordinate any grading,
construction or vegetation management plans near this line. OPPD also
has existing distribution equipment that runs through the property.
Coordinate with OPPD on removal/relocation of equipment if necessary.
Water, gas, and electricity will be provided as required by Chapter 53,
Subdivisions, of the Omaha Municipal Code.
Grading and
Drainage:
The development must comply with all stormwater management ordinances
and policies, including no net increase in stormwater runoff and treatment
of the first half inch of stormwater for water quality.
Environmental: A tree canopy analysis and acceptable mitigation plan has been submitted.
The mitigation plan is included as a part of the subdivision agreement and
a note must be added to the plat stating that Lots 1-18 and Outlots A-C are
subject to compliance with the mitigation plans included in the final
subdivision agreement.
Land Use and
Planning:
The proposed subdivision will continue use of the site with single family
residences, which are appropriate for the existing Low Density Residential
land use designation.

The project furthers the goals of the Concept Element of the Master Plan
regarding infill development, including encouraging “the development of
infill housing which makes use of vacant land and existing under-utilized
central city infrastructure” (p. 31) and providing “good quality housing”
options in a “mix of patterns, types, and styles” (pp. 18-19).
III. ANALYSIS:
Conditionally, the plat complies with the goals and objectives of the Omaha Master Plan and
the requirements of Chapter 53, Subdivisions, of the Omaha Municipal Code.
IV. RECOMMENDATIONS:
Approval of the rezoning from R2 to R4.
Approval of the waiver to Section 53-8(2b), Cul-de-sac length.
Approval of the Preliminary Plat, subject to the following conditions:
