The applicant is TACK Architects. CASE DESCRIPTION: The purpose of the request is to replat and rezone 0.70 acres of land into one (1) lot to allow for construction of a building addition to the Completely Kids facility. Approval of a rezoning from DS-Downtown Service District to CBD-Central Business District (properties are also located within an ACI-1(PL) Overlay District) will accompany the final plat. DEPARTMENT RECOMMENDATION: Approval of the preliminary plat subject to the following conditions: 1. Compliance with all stormwater management ordinances and policies; including providing for a no net increase in stormwater runoff and treatment of the first 1/2 inch of stormwater for water quality. 2. GENERAL INFORMATION Purpose: To replat and rezone 0.70 acres of land into one(1)lot to allow for construction of a building addition to the Completely Kids facility. Existing Land Use: Commercial Existing Zoning: DS-ACI-1(PL) Adjacent Land Use and Zoning: North Multiple Family Residential DS-ACI-1(PL) South Commercial DS-ACI-1(PL) East Commercial/Industrial DS-ACI-1(PL) West Commercial(Surface Parking) GC-ACI-1(PL) Zoning History: C10-10-094:Approval of an ACI-1(PL)-Area of Civic Importance Overlay District, 8/31/10. C3-04-179:Approval of Destination Midtown Plan,approved 8/17/04. Future Land Use Plan Designation: Downtown Mixed Use Applicable Regulations: Upon rezoning the site will be subject to compliance with the CBD zoning classification site development regulations and the ACI-Area of Civic Importance Overlay District regulations,as applicable. No Building Permit will be issued based on a site plan which does not comply with the provisions of the Zoning Ordinance. Approval of the rezoning by the Planning Board and City Council does not include or imply an acceptance of the site plan for permit purposes. II.SPECIAL INFORMATION Site Characteristics: The proposed replat contains 0.70 acres of land located between 25th Avenue and 26th Street,north of St.Mary's Avenue. The existing site consists of the Completely Kids facility,a detached storage building/garage and a 14-stall off-street parking lot. Generally,the grade of the site slopes down from the north towards the south. Development Proposal: The Completely Kids facility is proposing to expand their facility by constructing an approximate 10,000 square foot addition to the east side of the existing building. The existing detached garage will be removed as part of the project. The facility also owns the existing 36- stall surface parking lot to the west,across 26th Street. Related to this request the applicant has also submitted a request for a Conditional Use Permit to allow Surface Parking in a GC District for the property at 2620 St.Mary's Avenue(C7-17-202). MRC Recommendation Report Completely Kids #C10-17-190,C12-17-191 Page 2 Public Improvements: New sidewalks in compliance with ACI requirements must be provided along St. Mary's Avenue and 25th Avenue. Grading and Drainage: Development will be required to comply with all applicable stormwater management ordinances and policies;including providing for a no net increase in stormwater runoff and treatment of the first 1/2 inch of stormwater for water quality. 'Land Use and Planning: The proposed replat to one lot and rezoning from DS to CBD is consistent with the subdivision regulations and the Downtown Mixed Use designation of the City's Future Land Use Plan. Furthermore,the proposed rezoning from DS to CBD is consistent with the Downtown Master Plan,which calls for infill and redevelopment along the St.Mary's Avenue corridor. III. ANALYSIS Conditionally,the proposed subdivision is in conformance with Chapter 53 Subdivision of the Omaha Municipal Code and the City of Omaha Master Plan. Additionally,the proposed rezoning is consistent with and carry out the goals and objectives of the City of Omaha Master Plan. IV. RECOMMENDATION Approval of the rezoning from DS to CBD. Approval of the Preliminary Plat,subject to the following conditions: 1) Compliance with all stormwater management ordinances and policies;including providing for a no net increase in stormwater runoff and treatment of the first 1/inch ofstormwater for water quality 2) Provide sidewalks in compliance with ACI requirements along St.Mary's Avenue and 25th Avenue. Approval of the Final Plat,subject to the conditions of the Preliminary Plat approval and submittal of an acceptable,final subdivision agreement,if necessary,prior to forwarding the request to the City Council.
