Transmitted herewith is a Resolution approving an extension to a contract with Faure
Enterprises, Inc. for an open order for maintenance painting of equipment and structures at the
wastewater treatment plants and sewage lift stations. The original contract was approved by the
City Council on January 30, 2007 by Resolution No. 136.
The original contract allowed for extensions of the Agreement for maintenance painting. The
Public Works Department wishes to extend this Agreement for an additional year at the original
cost not to exceed $97,180. The cost of this open order will be paid from the Sewer Revenue
Fund 21121, Missouri River Plant Maintenance Organization 116613.
The contractor has a current Annual Contract Compliance Report Form CC-1 on file in the
Human Rights and Relations Department.
The Public Works Department requests your approval of this Resolution.

SECTION 1 —GENERAL REQUIREMENTS
1.1 SUMMARY OF WORK
A. The work covered by this specification consists of furnishing all labor, equipment,
supplies and materials, and performing all service operations to provide
maintenance painting and coating system services for interior and exterior
equipment,piping, walls, floors, as directed by the City Inspector, at the
following City of Omaha facilities:
o Missouri River Wastewater Treatment Facility, 5600 So. 10th Street,
Omaha,NE
o Papillion Creek Wastewater Treatment Facility, 15705 Harlan Lewis
Road, Bellevue, NE
o Approximately seventy(70) remote sewer lift and grit removal stations.
(Located in Omaha, Douglas County Vicinity)
B. It shall be the responsibility of the bidders to familiarize themselves with the
equipment, services to be performed, and the environment prior to submitting a
bid. Lack of knowledge concerning any or all parts of the work shall not be
accepted after the bid opening.
C. Work is to be performed by qualified and trained personnel. Qualifications are
required to be submitted with the bid.

1.2 APPLICABLE PUBLICATIONS
A. CITY OF OMAHA- (2003) Standard Specifications and Plates for Public Works
Construction, 3rd Edition. A copy may be obtained from the City's web site:

B. These Special Provisions are considered a Supplemental Specification to the City
of Omaha Standard Specifications. The Contractor is still responsible for also
adhering to the Standard Specifications. The General Provisions that are
applicable to the work are not reiterated in this document, unless a modification is
made. Should there be a discrepancy between these Special Provisions and the
City Standard Specifications, this specification prevails.
C. All work shall comply with the City of Omaha Municipal Code. A copy of the
code can be obtained from the City of Omaha's website, www.ci.omaha.ne.us,by
clicking on Municipal Code.
1.3. CONTRACT TIME
A. The contract shall be set up as an open order for a time period of one (1) calendar
year from the date of award. Bid price may be extended for two (2) additional
one-year periods with the approval of the City of Omaha with an annual price
escalation agreement in the second and third year as outlined in Paragraph B.
B. At the end of each contract year, this contract shall be review and the unit price
may be revised for the next year up to seventy-five (75)percent of the difference
between the US Labor Department's Consumer price index for all urban
consumers (CPI-U) for the Anniversary month of the contract and the initial
month of the current contract year. The revised price will be negotiated with the
contractor. Revised prices cannot exceed the limits calculated by the following
formulas:
• The index obtained from the Region VII US Department of Labor, Bureau of
Labor Statistics, will be used in the formula below to the nearest cent.
• CPI for the anniversary month—CPI for last years anniversary month=
difference. Difference x .75 =Adjusted Difference
• Last years anniversary month CPI+adjusted difference=Adjusted CPI
• Adjusted C.P.I. =PRF =Price Revision Factor last years anniversary month CPI
• PRF x (Original or Adjusted Unit Price) =New unit price for next year's
agreement.
C. Following formal written notice of non-compliance with City specifications, the
City may terminate its agreement with the Contractor. If the contract is
terminated, the City reserves the right to award the contract to the next lowest
bidder.

1.4 BOND AND INSURANCE REQUIREMENTS
A. The successful bidder shall provide Performance Bond equal to bid amount and
Certificate(s) of Insurance within ten(10) days from Notice of Award.
B. The Contractor shall carry public liability insurance to indemnify the public for
injuries sustained by reason of carrying on the work. The coverage shall provide
the following minimum limits based on dollar amount of the bid: •
Bodily Injury $200,000 or Under Over $200,000

C. The City of Omaha shall be named as additional insured with the Contractor.
D. Contractor shall procure a policy or insurance which shall guarantee payment of
compensation according to the Workmen's Compensation Laws of Nebraska for
all workmen injured in the scope of employment; and further agrees to keep said
policy or insurance in full force and effect throughout the terms of this Contract.
In addition, all other insurance in any way required of Contractor shall be
procured by the Contractor and kept in force by Contractor throughout the teiizi of
this Contract.
1.5 SAFETY
A. Contractor is responsible for his own safety plan, equipment,personal protection
equipment, and procedures in accordance with federal, state, and local
regulations.
B. The City of Omaha Environmental Services Safety Manual is available for review
upon request of the Contractor/Subcontractor. The manual is the City of Omaha's
safety plan for employees and review of said document does not relieve
Contractor/Subcontractor of having his own safety plan,providing proper safety
equipment, and being responsible for his employee's safety in accordance with
federal, state, and local regulations. The City of Omaha is not responsible for
Contractor safety or that of his Subcontractors.
C. Contractor shall note that work is at a wastewater treatment plant and at lift
stations where exposure to typical materials common in wastewater may occur.
Contractor is responsible for his own monitoring of toxic and explosive
atmospheres, as necessary.

1.6 UTILITIES
A. Electrical and nonpotable water are available for Contractor's use.
B. Contractor shall be responsible for providing any hoses or extension cords
necessary to access utilities.
1.7 POINT OF CONTACT

1.8 CONTRACT METHOD

B. Minor items shall be furnished if not specifically called for in the specifications.
C. Provide a list of references for a minimum of three different industrial painting
projects within the last five years. Include the name and telephone number for the
reference person familiar with your work. This shall be included with the bid
documents.
D. Provide experience resumes for all proposed personnel working to be assigned to
this contract. Resumes shall also include proof of certification and/or training to
apply coatings. Should personnel change after the Award, the Contractor shall
submit the resume and certification of the replacement employee prior to the
employee starting work onsite.
1.9 PERMITS
A. Contractor is responsible for obtaining all applicable permits associated with the
Work. Permits from the City will be issued to the Contractor at no cost.

To Public Road At-Grade Crossing Agreement
1.10 PAY REQUESTS
A. Pay requests shall be submitted once per month listing what areas were painted,
project location, labor, and materials costs. All material costs shall be supported
with attaching invoices to the payment request. The Contractor shall only be
paid for what material was used during the month.
B. The City Inspector will be providing the Contractor a work order for each
painting project. The Contractor shall return the completed work order to the City
Inspector stating how many people worked on the project,number of labor hours,
and what materials were used upon completion of each project. If work has
deviated from the work order, the Contractor shall also describe the deviation.
C. The City Inspector will review the Contractor's invoices against the work order
history and inspection logs. The Contractor will be paid within 30 days of
submittal.
1.11 HOURS OF WORK
A. Inspections will be performed by the City Inspector between the hours of 7:30am
and 2:30pm Monday through Friday.
B. The Contractor is allowed to work from 7:00am to 5:00pm within the plant
facilities. Work at the stations shall be coordinated with the City Inspector for
accessibility, and occur between 7:30am and 3:00pm. Work shall take place
Monday through Friday.
C. When City offices are closed to recognize an event,holiday, or because of
weather conditions, the Contractor will not be allowed to work on these days.
SECTION 2 -COATING
PART I—GENERAL
1.1 SUBMITTALS
A. Material Safety Data Sheets (MSDS) for each paint system.
B. Manufacturer Technical Data Sheets that includes written instructions and special
details for applying each type of paint.
C. Paint Colors.
1.2 QUALITY ASSURANCE
A. Three years experience in industrial coating applications shall be required of all
personnel on the job.
B. The Contractor shall provide proper supervision to coordinate work between the
City of Omaha, the Contractor, and any Subcontractors. The supervisor shall be
knowledgeable and be able to instruct the Contractor's and Subcontractor's

note that work is at a wastewater treatment plant and at lift
stations where exposure to typical materials common in wastewater may occur.
Contractor is responsible for his own monitoring of toxic and explosive
atmospheres, as necessary.

1.3 DELIVERY, STORAGE AND HANDLING
A. Store products in a protected area that is heated or cooled to maintain
temperatures within the range recommended by the paint manufacturer.
B. No more than 25 gallons of product may be stored onsite. This includes paint,
coating, thinner, cleaner, or any other solvents.
C. Containers kept onsite shall be stored properly in an area designated by the City
Inspector. No open containers are allowed.
1.4 ENVIRONMENTAL REQUIREMENTS
A. Follow manufacturer's requirements for atmospheric conditions (i.e., temperature,
humidity, etc.)when applying coatings.
PART 2-MATERIALS •
2.1 GENERAL
A. The successful bidder shall furnish all equipment and supplies necessary to fulfill
the requirements of this contract. Items that are considered as supplies are, but not
limited to,brushes, rollers,buckets, drop cloths, and hand tools.
2.2 MANUFACTURER
A. Tnemec or ICI-Devoe.
2.3 PAINT MATERIALS
A. When applying a paint system,primer and finish coat materials shall be produced
by the same manufacturer.
B. Thinners, cleaners, driers, and other additives shall be as recommended by the
manufacturer of the particular coating.
C. Formulate paints with colorants free of lead, lead compounds, or other materials
that might be affected by presence of hydrogen sulfide gas.

A. Remove, mask, or otherwise protect hardware, lighting fixtures, switchplates,
aluminum surfaces, machined surfaces, couplings, shafts,bearings, nameplates on
machinery, and other surfaces not specified elsewhere to be painted.
B. Provide drop cloths to prevent paint materials from falling on or marring adjacent
surfaces.
C. Protect working parts of mechanical and electrical equipment from damage during
surface preparation and painting process.
D. Mask openings in motors to prevent paint and other materials from entering.
E. Protect all surfaces adjacent to, or downwind of Work area from overspray.
3.2 SURFACE PREPARATION
A. Surface preparation shall be in accordance with The Society for Protective
Coatings (SSPC) Specifications, including but not limited to:
a. SP1, Solvent Cleaning
b. SP2: Hand-Tool Cleaning
c. SP3: Power Tool Cleaning
d. SP5: Joint Surface Preparation Standard White Metal Blast Cleaning
e. SP7: Joint Surface Preparation Standard Brush-Off Blast Cleaning
f. SP10: Joint Surface Preparation Standard Near-White Blast Cleaning
g. SP13: Surface Preparation of Concrete
B. The City Inspector shall determine which surface preparation shall be used and
include this information on the work order given to the Contractor.
C. The City Inspector shall be notified when surface preparation is completed for
inspection prior to applying coatings. Any coatings applied before approval of
the surface preparation is given shall be removed and replaced by the Contractor
at no extra cost to the City.
3.3 PAINTING
A. Apply coatings in accordance with manufacturer's instructions. Do not exceed
the application rate.
B. Additional coats may be required to obtain minimum required paint thickness,
depending on method of application, differences in manufacturers' products, and
atmospheric conditions. The City Inspector will verify dry film thickness
readings of all coatings applied.
C. The City Inspector shall determine the coating system to be used and include this
information on the work order form.

A. The City of Omaha standard paint color chart is attached. Verify color selection
with City Inspector prior to the work.
B. Proprietary identification of colors is for identification only. Selected
manufacturer may supply matches.
C. All pipes shall be labeled to match existing labeling system.
3.5 TESTING
A. Measure coating thickness in mils with a magnetic type, dry film thickness gauge.
B. Holiday detect coatings 20 mils thick or less, except zinc primer and galvanizing,
with low voltage wet sponge electrical holiday detector as directed by the City
Inspector. For 20 mils thick or more, use a high voltage spark tester.
C. After repaired and recoated areas have dried sufficiently, retest each repaired area.
3.6 CLEANUP
A. Place cloths and waste that might constitute a fire hazard in closed metal
containers or destroy at the end of each day.
B. Completely remove paint spots, oil, or stains upon adjacent surfaces and area
clean.
C. Brushes or accessories will not be allowed to sit at the work site in an open
container of cleaning solvents overnight.

Please prepare a resolution for City Council approval to exercise our final option year for
the maintenance painting contract. Faure Ent, Inc. DBA Painting and More has chosen
not to modify the pricing in 2009 and therefore the annual cost of$97,180 for
maintenance painting and coating per bid specifications for the Missouri River
Wastewater Treatment Plant, the Papillion Creek Wastewater Treatment Plant, and the
Lift Stations from Faure Ent, Inc. DBA Painting and More is acceptable. Funds for this
contract should come from cost center 21121-116613-42411.
Please prepare the appropriate paperwork to award this contract as soon as possible.

WHEREAS, the City Council approved by Resolution No. 136 on January.30, 2007 an
Agreement for maintenance painting of equipment and structures at the wastewater treatment
plants and sewage lift stations; and, .
WHEREAS, Faure Enterprises, Inc. was awarded the contract for maintenance painting
in the amount of$97,180.00 for the first year of this contract; and,
WHEREAS, the maintenance painting contract has provisions for extensions of the
contract and the City of Omaha, Public Works Department now wishes to extend this Agreement
for an additional year at the same annual cost; and,
WHEREAS, the cost of this open order for maintenance painting, not to exceed $97,180
for the next contract year, will be paid from the Sewer Revenue Fund 21121, Missouri River
Plant Maintenance Organization 116613, year 2009 expenditure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the extension of the contract with Faure
Enterprises, Inc. for maintenance painting of equipment and structures at the wastewater
treatment plants and sewage lift stations is hereby extended for one year.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay $97,180.00 for maintenance painting
