Transmitted herewith is a Resolution authorizing the payment to Frontier Harley-Davidson in the amount
of$43,818.00 for fifteen (15) TourPak emergency braking system lights for the 2009 leased motorcycles
for the Omaha Police Department Traffic Unit.
The Omaha Police Department currently leases motorcycles from Frontier Harley-Davidson with a six-
year agreement term for Years 2007—2012.
Frontier Harley-Davidson is a sole source vendor and a firm qualified to provide the product
contemplated herein. The current lease agreement states that no maintenance, modification and/or
repairs shall be performed by any other party other than Lessor without the explicit consent of Lessor.
Non-conformity with this provision shall place the Lessee in default. In accord with the provisions of
Section 5.16, Home Rule Charter, when there is a sole source vendor, the City Council may, by
resolution, authorize the Purchasing Division to issue a purchase order for the product.
Since the initial purchase of the radio boxes and light kits, improvements have been made in the area of
lighting visibility as well as officer safety, with the integration of high mount brake lights and improved
wiring.
Funds of $43,818.00 have been appropriated in the Year 2009, General Seized Assets Fund 12156,
Organization 130711, Account 44126 Traffic Enforcement Equipment. The Finance Department is
authorized to pay the cost from this account.

WHEREAS, Frontier Harley-Davidson submitted a quote for fifteen-(15) TourPak

Department Traffic Unit; and,
WHEREAS, Frontier Harley-Davidson is the sole source vendor; providing a unique and
non-competitive product, as Lessor under the current lease agreement which states that no

without the explicit consent of Lessor; and,
WHEREAS, As provided in Chapter 5.16 of the Home Rule Charter 1956 as amended, no
competitive bidding is necessary or possible; and,
WHEREAS, Frontier Harley-Davidson is a firm qualified to provide the product
contemplated herein in the amount of$43,818.00; and,
WHEREAS, the Mayor has recommended the authorization of this payment.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF

THAT as recommended by the Mayor, the purchase based upon the quote of Frontier
Harley-Davidson, providing a unique and non-competitive service, in the amount of$43,818.00,
