RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, on January 6, 2010, the One-Hundred and First Legislature of the
State of Nebraska, Second Session,will convene; and,

WHEREAS, it is in the best interests of the City of Omaha and its residents that.a.
legislative package be prepared for submission to the State Legislature; and,
WHEREAS, it is the purpose of this resolution to approve a specific proposal for
inclusion in that package; and,
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, at the request of Councilmember Garry Gernandt, the legislative package
of the City of Omaha for the Second Session of the One-Hundred and First Legislature of the
State of Nebraska shall include a proposal to amend existing statutes relating to vehicular
pursuits and liability to injured innocent third parties, insurance requirements, and penalties.

injured innocent third parties by revising mandatory insurance requirements, revising
penalties for not having insurance, creating a statewide pool for reimbursement,
providing requirements for the DMV on reporting cancellation of insurance, stricter
penalties for fleeing with passengers etc. (Gernandt)
h) Support for legislation, if introduced, requiring county assessors to reassess all

In connection with the issuance of the Bonds, we have examined the following:
(a) the Articles of Incorporation and Bylaws of the Corporation;
(b) the Resolution;

"Event of Default" shall not apply to any such failure. The Trustee shall not
have the power or duty to enforce this Letter Agreement. If the City fails to comply herewith,
any Bondholder may take such actions as may be necessary and appropriate, including seeking
specific performance by court order,to cause the City to comply with its obligations hereunder.

general obligation indebtedness, plus 0.600 cents per $100 for satisfaction of judgments and 1.594 cents
per $100 for payment on the City's Special Redevelopment Levy, for a total levy of 47.587 cents per
$100.

Obligations"). An amount equal to the excess of the issue price of a Premium Obligation over its stated

constant yield principles, based on the purchaser's yield to maturity (or, in the case of Premium
