Transmitted herewith is a Resolution approving an Amendment to the existing Subdivision
Agreement between the City of Omaha and East Campus Realty, LLC. The original Subdivision
Agreement was approved by the City Council by Resolution No. 1429 on December 11, 2007.
The amendment to the agreement will allow the Subdivider to purchase and install pedestrian
scale light matching the lighting on Farnam Street from Turner Boulevard to 34th Street. The cost
of said lighting increase the reimbursement to East Campus Realty, LLC by $75,000 which will
be paid from the 2006 Transportation Bond Fund 13182, 2009 Issue Transportation Bond
Organization 117114.
The Public Works Department requests your consideration and approval of the attached
Resolution and Amendment to the Subdivision Agreement.

AMENDMENT NUMBER 1 TO SUBDIVISION AGREEMENT
MIDTOWN CROSSING AT TURNER PARK
(Lots 1-5,inclusive, and Outlots 1-4)
THIS AMENDMENT, made and entered into this a/'_ day of Q�iJO�/ , 20ef, by
and between East Campus Realty, LLC (hereafter referred to as "Subdivider") and the City Of
Omaha, a Municipal Corporation in the State of Nebraska(hereinafter referred to as "City").
WHEREAS, the City desires amend the Subdivision Agreement dated December 11, 2007 to
allow for the installation pedestrian lights along Farnam Street from 29th Street through Turner
Boulevard and from 34th Street through 36th Street;
NOW THEREFORE, it is hereby agreed that the existing Agreement be amended as follows:
1. The Subdivider shall purchase and install pedestrian scale lights matching the
lighting on Farnam Street from Turner Boulevard to 34th Street.
2. The City shall reimburse the Subdivider for all costs associated with said lighting
(currently estimated to be $75,000.00).
3. The City shall pay for the energy and maintenance costs associated with the
pedestrian scale lighting, including as necessary the replacement of the lighting
fixtures and poles, after application of any supplier/contractor warranty benefits
available to the Subdivider.
This Amendment shall be deemed a part of and subject to all terms and conditions of the existing
Agreement.
IN WITNESS WHEREOF, we, the executing parties, by our respective duly authorized agents,
hereby enter into this Amendment, effective on the day and year first above written.

WHEREAS, a Subdivision Agreement between East Campus Realty, LLC and the' City

built by East Campus Realty and to be paid for by the City of Omaha for the Midtown Crossing
Subdivision, located in the vicinity of Turner Boulevard to 33ra Street and Harney Street to
Dodge Street; and,
WHEREAS, it is necessary to amend the Subdivision Agreement to allow for installation
of pedestrian scale lights matching the lighting on Farnam Street from Turner Boulevard to 34th
Street; and,
WHEREAS, the addition of these lights will increase the City of Omaha's cost stipulated
in the agreement by $75,000.00, which will be paid from the 2006 Transportation Bond Fund

between East Campus Realty, LLC and the City of Omaha for additional lighting for the
Midtown Crossing Subdivision, located in the vicinity of Turner Boulevard to 33rd Street and
Harney Street to Dodge Street, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay East Campus Realty, LLC the
additional fee of$75,000.00 for the additional lights from the 2006 Transportation Bond Fund
13182, 2009 Issue Transportation Bond Organization 117114.
