ORDINANCE NO. Ciec2/5
AN ORDINANCE to approve the creation of an Area of Special Graphic Control located at 414
South 13t" Street and 1301 Harney Street,to approve the Special Sign and Graphics Control
Plan, and to provide for an effective date.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. In accordance with Sections 55-845 of the Omaha Municipal Code, a Area of
Special Graphic Control and the Special Sign and Graphics Control Plan,attached hereto and made a
part hereof, are hereby approved, for the following described land in Douglas County, Nebraska:
Lots 1-2 and 7-8;the East 21.06 feet of Lot 6;the east 17.5 feet of Lot 3 and that part
of Lot 3 described as follows:Beginning at the Southeast corner of the West 48.5 feet
of said Lot 3;thence North 00°00'23"West(assumed bearing),for 10.05 feet,along
the East line of the West 48.5 feet of said Lot 3; thence North 89°34'57" West, for
3.73 feet;thence South 00°00'33"East,for 20.08 feet,to the centerline of the vacated
alley;thence North 89°59'34"East,for 3.73 feet,along said centerline;thence North
00°00'23"West,for 10.00 feet,to the Point of Beginning;and adjacent vacated alley,
all in Block 149, Omaha City Lots.
Section 2. The proposed Area of Special Graphic Control will provide for the redevelopment
of the property as a pedestrian gathering space with a digital sign to display information and events
of general public interest. The location adjacent to the Chamber and the Old Market make it ideal
for such a purpose. The area is heavily traveled (both auto and pedestrian) by local citizens and
visitors to the community. As such,an attractively designed corner complete with the provision of
useful local information will be a benefit to the community and its visitors.

Section 3. An electronic sign within the Area of Special Graphic Control and authorized by
the attached Special Sign and Graphics Control Plan shall comply with Section 55-854 of the Omaha
Municipal Code in regards to brightness,image restriction and transition time,except as modified by
the said Plan.
Section 4. This Ordinance shall be in full force and effect fifteen(15)days from the date of
its passage.

Operating Statement:
The Chamber will control all messages and digital graphics on the LED screen. The images and
messages displayed on the LED screen will be restricted to a minimum duration of 10 seconds or
longer. Images and messages will be restricted to the promotion of the Chamber events and will
include sponsor names and/or logos and serve as public service announcements to promote
community and public attractions such as festivals, museums, music, art and entertainment. No
advertising is allowed on the LED screen.
The Chamber will also utilize the LED screen for limited special events. These special events
will occur on average once per week and will average 2 to 6 hours per event. Events may
include Chamber membership events such as Coffee and Contacts, Rush Hour Connections,
Business After Hours, holiday celebrations, Chamber open houses, recognition and staff events.
Featured ballgames (such as Huskers, Bluejays and Mavericks), classic movies and educational
videos (Nebraska Statewide Arboretum programs on native trees, grasses and wildflowers) will
be shown.
While this special events list is not all inclusive, and due to the fact that the Chamber may have a
special event not currently envisioned, we would ask the City for its discretion to allow the
Chamber to hold additional events on an as-needed basis.
The Chamber shall coordinate with Omaha Public Works and the Omaha Police Department
should pedestrian or vehicle traffic become problematic during the described "special events"
where the operating standards will differ from those provided in the code.
All other signage on site must meet applicable city ordinances.
