Jerram, and Festerson. The Ordinance allows, subject to certain regulations consistent with state
law, the solicitation of charitable contributions from the side of roadways with certain •

5 BE IT:ORDAINED BY THE CITY•COUNCIL)OF THE CITY OF,OMAHA:
6 Section 1. That Section 36-108.of the Omaha Municipal Code is hereby amended to read

8 Sec. 36-108. Soliciting rides or.business.

10 (1) No person shall, stand in. a roadway,for the purpose of
11 soliciting a ride, employment, contributions or business
12 from the occupant of any vehicle.
13
14 (2) No person shall stand on or in proximity to a street or
15 highway for the purposes of.soliciting the watching or
16 guarding of any vehicle while parked or about to be parked
17 on a street or highway.

19 (3) Exception to items 1 and 2'above will be`allowed for the
20 purposes of soliciting contributions which,are to be devoted
21 to charitable or community betterment.purposes,:as defined.
22 herein, from the occupanroLany vehicle when stopped by
.23 traffic control devices or,traffic control signals; within a
24 roadway which is not part of the state highway system, or
,25 not .otherwise part of the 20 top Average Daily Traffic
26 intersections in the city, provided, that such.person and the
27 charity shall first comply with subsection (4)below.

29 (4) A charity or community.betterment organization-must be a
30 501, (c) organization as recognized by the IRS and such
31 organization and its solicitors, seeking to solicit
32 contributions from those using a roadway shall comply

24 years'Of age_ All roadway solicitors shall wear an
25 optically bright yellow'safety-.vet 'conforming to
26 ANSI specifications while soliciting:in the area of
27 the roadway and all..shall sign and deliver to the
28 ' City a liability`waiver .holding the' city harmless
29 from all claims subject to waiver under the laws of
30 the State.

33 solicitation only two times in twelve consecutive
34 calendar months arid' for a duration of no greater
35 than four consecutive days each time.

14 . of any vehicle or otherwise do:anything aggressive
15 . . or intimidating when soliciting;

17 5) All solicitation sites shall have a clear line of
18 sight for approaching', motorists ^on' the 'affected
19. roadway of at least five-hundred feet.

21 (f) In any event, the permit.granted herein subject subject to
22 the inherent exercise,of the City's-Police power to
23 cause the suspension of any solicitation activity that
24 is at such time and place causing an actual hazard
25 on or near the roadway or which is unduly
26 hindering the free movement of traffic.

28 Section.2. That Section 36-108 of the Omaha Municipal Code as heretofore existing is
29 hereby repealed.
30 Section 3. That this Ordinance shall be in full force and take effect fifteen days from and
31 after the date of its passage provided that no solicitation permitted hereunder may occur prior to

7. Sec.36-108. Soliciting rides or business.
(1) No person shall stand in a roadway for the purpose of soliciting a ride,employment,
contributions or business from the occupant of any vehicle.
(2) No person shall stand on or in proximity to a street or highway for the purpose of soliciting
the watching or guarding of any vehicle while parked or about to be parked on a street or
highway.
(3) Exception to items 1 and 2 above will be allowed for the purposes of soliciting on behalf of a
charity,charitable contributions from the occupant of any vehicle within a roadway;provided,
that such person and the charity shall first comply with subsection
(4)below.
(4) A charity and it's solicitors,seeking to solicit contributions from those using a roadway shall
comply with the following:
(a) At least seven days prior to the date of the proposed solicitation,the charity

city. The registration shall state the date,time and location of the proposed
solicitation.Copies of the registration shall be forwarded to the director of the
public works department and to the chief of police.
(b) Each person who will be engaging in roadway solicitation shall sign an
information form,which shall be available,upon request.The information form
shall set forth the rights and duties of persons serving as roadway solicitors
under this section,and the fact that such persons understand the same.
(c) A roadway solicitor shall be at least eighteen years of age.All roadway
solicitors
shall wear an optically bright yellow or orange safety vest while soliciting in the
area of roadway solicitation.
(d) A charity may engage in roadway solicitation only two times in a calendar
year,
and for a duration of no greater than five days each time.
(e) Such charity must have trained personnel and such personnel hold State of
Nebraska certification as Emergency Medical Technicians(EMT)on sight at
each location for the duration of the solicitation and such certifications must be
provided if requested.
Section 2. Section 36-108 of the Omaha Municipal Code as heretofore existing is hereby repealed.

21 to charitable or community betterment purposes, as defined
22 herein,from the occupant of any vehicle when stopped by
23 traffic control devices or traffic control signals, within a
24 roadway which is not part of the state highway system, or
25 not otherwise part of the 20 top Average Daily Traffic
26 intersections in the city,
provided, that such person and the
27 charity shall first comply with subsection (4)below.

4 solicitations and shall be accompanied by payment
5 of the permit fee in the amount of $$ .. Copies of

8 assignments indicate the advisability of a longer
9 time, the Public Works Director can change such
10 seven day advance requirement to any time not
11 exceeding thirty days. •

13 (b) Each person who will be engaging in roadway

16 showing they have completed instruction regarding
17 safe roadway operations from materials developed
18 by the City of Omaha. Each solicitation site shall
19 have at least one involved person present who is at
20 least 21 years of age

23 (c) All roadway solicitors shall be at least eighteen
24 years of age. All roadway solicitors shall wear an
25 optically bright yellow safety vest conforming to
26 ANSI specifications while soliciting in the.area of
27 the roadway and all shall sign and deliver to the
28 City a liability waiver holding the city harmless
29 from all claims subject to waiver under the laws of
30 the State.

32 LLD. A charity or organization may engage in roadway
33 solicitation only two times in twelve consecutive
34 calendar months and for a duration of no greater
35 than four consecutive days each time.

5 holidays may occur only between one half hour
6 after sun rise until one half hour before sunset and
7 those on all other days only from 9:00am until 4:00

10 4) The charity shall provide insurance, and a
11 certificate as proof of the same, covering the City of
12 Omaha as an additional insured on general liability
13 arising from such activity in the minimum of one
14 million dollars per person, two million aggregates

16 5)No solicitor may touch or knock upon any part of
17 any vehicle or otherwise do anything aggressive or
18 intimidating when soliciting;

20 6)__ All solicitation sites shall have a clear line of
21 sight for approaching motorists on the affected
22 roadway of at least five-hundred feet.

24 (f) In any event, the permit granted herein is subject to
25 the inherent exercise of the City's Police power to
26 cause the suspension of any solicitation activity that
27 is at such time and place causing an actual hazard
28 on or near the roadway or which is unduly
29 hindering the free movement of traffic.
