and Members of the City Council,
The attached proposed Ordinance of Necessity authorizes the acquisition of a vacant lot within
the Park Avenue Redevelopment Plan Area. The property is located at 1130 South 30th Avenue,
as shown on the attached map. Under this Ordinance the City will acquire the property as a site
for the relocation of an existing house from 1111 South 30th Avenue to allow for site
redevelopment as off-street parking for the adjacent townhouse complex. The developer will
rehabilitate the relocated house at its expense. ,
The City Council allocated federal Community Development Block Grant funds in the 2009
Consolidated Submission for Community Planning and Development Programs Action Plan for
property acquisition for housing. The estimated $10,000.00 cost of acquisition will be paid from
the FY 2009 Community Development Block Grant, Fund No. 12195, Organization No. 12161.
The City of Omaha will have the property appraised and will offer just compensation to the
owners. If the City is unable to negotiate the purchase price, the property will be acquired
through eminent domain proceedings.

AN ORDINANCE declaring the necessity of appropriating, for the use of the City of Omaha,
certain hereinafter described vacant property located in the Park Avenue Redevelopment
Plan Area, at 1130 South 30th Avenue, for acquisition, relocation as appropriate, and
subsequent use as a site for implementing the Park Avenue Redevelopment Plan;
provided that as to each specified parcel which cannot be obtained by negotiation,
proceedings in eminent domain be undertaken and completed; and, providing for the
effective date hereof. Funding shall be payable from FY 2009 Community Development
Block Grant, Fund No. 12195, Organization No. 12161.
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
Section 1. That it is proper and necessary, pursuant to the Nebraska Community
Development Law, to appropriate a vacant property located at 1130 South 30th Avenue as
outlined on the attached map, and that this vacant property necessary for such purpose is in
Douglas County,Nebraska and is more particularly described as follows:
1130 South 30th Avenue
Lot 8, Block 5, Hanscom Place, an addition to the City of Omaha, as surveyed, platted
and recorded in Douglas County,Nebraska.
Section 2. That the City of Omaha is authorized, empowered and directed to negotiate,
through either employees of the City of Omaha or through persons employed therefore or
through any combination thereof, with the owners of the above described property for the
acquisition of said property by the City of Omaha for the aforesaid purposes. Upon failure to
agree to negotiation with the owner of any of the above described property for the acquisition
thereof by the City of Omaha, the City is authorized, empowered, and directed, through the Law
Department, to proceed forthwith to acquire such property not obtained by negotiation, by
proceedings in accordance with the laws of the State of Nebraska, under the power of eminent

away" urethane sealant which will allow a quick return to service. For comparison purposes, all windshields
should meet or exceed PPG's OEM specifications. In no case will replacement glass be"blems." The successful
bidder will keep the City of Omaha supplied with the most current copy of the NAGS Calculator publication.
