The Resolution asks the Nebraska Liquor Control Commission to require Claiborne Centre,LLC,doing business as Omaha Keno King at 6553 Ames Avenue Omaha, Nebraska, to submit a long-form application before renewal of its Class "I" liquor license. State statutes permit the City Council to request that a liquor licensee submit a formal application and undergo a public hearing before the license is renewed. If a proper renewal protest is filed by three or more residents the Council must hold a hearing to consider the protest. State law provides that a licensee is entitled to renew its license only if the licensee continues to meet the requirements that existed when the license was last issued. A license need not be renewed if there is a change of circumstances affecting the qualifications for the license. For example,renewal can be denied if the licensee's conduct shows it is not willing to follow liquor laws. A proper protest against the renewal of this license was timely filed with the City Clerk and signed by three persons giving residential addresses in the city. Therefore, a hearing must be held to consider this protest. Your hearing does not consider whether the license should be renewed. The only question at this time is whether there is sufficient reason to believe the licensee no longer meets the qualifications for • the license and that a formal hearing should be held to examine the qualifications. If a long-form application is filed, the licensee will come back before you to justify renewal at a hearing on the application. You would then decide whether the liquor license should be renewed. If this Resolution is adopted, the Liquor Control Commission must require this licensee to file the long-form application. On behalf of Alcohol Impact Coalition (AIC), a neighborhood coalition of thirteen neighborhoods, we stand in opposition to the Keno Kings request for an automatic renewal of their liquor license. As you know AIC has been concerned about the over saturation of alcohol outlets in our neighborhoods but we are also take note when problem businesses that sell or serve alcohol bring a negative criminal element to their area as well as cause quality of life issues to their surrounding neighbors. Keno King is one of those problem businesses and we support the Benson Neighborhood in their opposition to this license. This.keno bar is not only a determent to the neighbors living close by but to any citizen of this city who may be visiting this establishment. There have been numerous police calls to this location that involve shots fired, fights, etc. The owner has violated the city's condition to their keno license not to host parties and it warrants - notice that promises made to the city council to get a license are easily made but the lack of follow up is harder to come by. I hope that the city council will take to those broken promises to heart and deal with the owner in a swift and punitive manner. Residents in this neighborhood have the right to have a safe and peaceful neighborhood to raise their families and these ongoing problems only cause disinvestment and diminish the quality of life issues for this area. We ask that you deny the automatic renewal and even consider canceling the license altogether so the neighborhood does not have to wait several more months to have a new application work it's way through the system and let this business continue business as usual. Mumgaard,Deputy City Attorney SUBJECT: Liquor License Renewal Protest —Omaha Keno King I have reviewed the liquor license renewal protest submitted to your office challenging renewal of the retail license held by Claiborne Centre, LLC., dba "Omaha Kano King" at 6553 Ames Avenue. In my opinion, the protest is sufficient and a protest hearing must be held. However, the evidence must be limited in time. THE LEGAL STANDARD The Liquor Control Act sets a time when residents can protest the automatic renewal of a liquor license. See, Neb. Rev, Stat. § 53-1.35.0I. This protest is timely. If three or more residents properly protest, the City Council must hold a protest hearing to decide whether a long-form application should be required. Although a hearing must be held to consider whether an application should be filed, it is discretionary with the Council whether or not to request an application and further hearings. Not all protests trigger this mandatory protest hearing. The Supreme Court has Iimited when a renewal application can be requested. A renewal application can he requested only if there's '`a showing that [the licensee] did not meet one of the renewal criteria". Grand Island Latin Club v. Neb. Liquor Control Com'sn, 251 Neb. 61 (1996). These criteria include whether the information submitted in the last previous application remains the same in all G material respects and whether the licensee remains qualified to receive a license. This showing is to be made at the mandatory hearing and may be met by the protesters' testimony. That is, at the mandatory hearing the City Council should consider whether there is reason to believe: (1) something material about the licensee or the location has changed from when the license was last issued, or (2) that the licensee no longer meets the criteria in effect when the license was granted. SUFFICIENCY OF THE PROTEST The protest is signed by three persons giving addresses in Omaha, Although the protest itself is stated in vague terms, the protest seems to present two contentions: Buster Brown, City Clerk February 16, 2010 Page 2 SUBJECT: Liquor License Renewal Protests— Omaha Keno King 1. The licensee has violated or not conformed to an agreement made with the City Council in January, 2009, when it received permission to be a keno satellite location. 2. The location has been the scene of disturbances documented in police reports. Both of these contentions are sufficient to be the basis for requiring a renewal application. If the protest hearing produces evidence supporting these contentions, the Council may conclude that there is a change in circumstances sufficient to question renewal. THE NATURE OF THE COu NCIL'S REVIEW To comply with the Supreme Court's requirement of a "showing" that renewal criteria are not met, the review should look at whether the licensee or its owner: (a) is "fit, willing, and t able" to properly sell alcohol; (b) will in the future exercise sufficient "management and control" to insure that violations of liquor laws and regulations will not occur; or (c) is a "person of good character and reputation in the community". See, Neb. Rev. Stat. §§ 53-125 and 53-132. The legal standards raise three questions: Since the license was last issued, has the owner of the corporation shown he is not a person "of good character", that is, does he conduct his business in good faith and with honesty of purpose? (Neb. Rev. Stat. § 53-125(2) and C & L Co. v. Neb. Liquor Control Corn,sn 190 Neb. 91 (1973)). In answering this question the Council may consider whether the owner is failing to keep promises made to the Council. Since the license was last issued, has the owner shown he is unwilling to operate the business in compliance with laws regulating the sale of alcohol? These laws include regulations prohibiting a licensee from permitting or allowing disturbances or other illegal activity on the premises or adjacent outdoor areas and regulations requiring compliance with any promises or representations made to the Council? (Neb. Rev. Stat. § 53-132(2)). ➢ Since the license was last issued, has the owner failed to manage and control the activities on the premises? (Neb. Rev. Stat. § 53-132(2)). The testimony and evidence must be limited in time. The Council can only consider whether circumstances have changed since the license was last issued. This license was last issued on May 1, 2009. There are no statutory deadlines but it is best to complete the entire process before the license expires on May 1, 2010. You should notify the Liquor Control Commission that the protest has been received and request that the license not be automatically renewed until the City Council has an opportunity to consider the protest. Omaha Municipal Code section 15-32(a) requires that you notify the licensee of the hearing and I suggest all protesters should also be notified. This notice can be either in writing or by telephone. As you know AIC has been concerned about the over saturation of alcohol outlets in our neighborhoods but we are also take note when problem businesses that sell or serve alcohol bring a negative criminal element to their area as well as cause quality of life issues to their surrounding neighbors. Keno King is one of those problem businesses and we support the Benson Neighborhood in their opposition to this license. This keno bar is not only a determent to the neighbors living close by but to any citizen of this city who may be visiting this establishment. There have been numerous police calls to this location that involve shots fired, fights, etc. The owner has violated the city's condition to their keno license not to host parties and it warrants notice that promises made to the city council to get a license are easily made but the lack of follow up is harder to come by. I hope that the citycouncil will take to those broken promises to heart and deal with the owner in a swift and punitive manner. Residents in this neighborhood have the right to have a safe and peaceful neighborhood to raise their families and these ongoing problems only cause disinvestment and diminish the quality of life issues for this area. We ask that you deny the automatic renewal and even consider canceling the license altogether so the neighborhood does not have to wait several more months to have a new application work it's way through the system and let this business continue business as usual.
