resistance tires to install on eleven(1:1) city-owned fleet vehicles.
• Low rolling.resistance tires are an Environmental Protection Agency verified technology that
will reduce.diesel emissions from city fleet vehicles. Installation:of the tires will be provided as
a match by the City.of Omaha's Fleet Management Division. The_project.deadline is August 31,
2010.

Benson-Ames Alliance blighted and substandard study area be declared blighted and substandard.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OMAHA:
THAT, the Benson-Ames Alliance blight and substandard study area with the following
boundaries: Northwest Radial Highway on the north and east, north to 58th Street approximately one-half
blocks then east to 57th Street, south to the alley south of Maple Street on the east, west to 63rd Street—
excluding three parcels up to 58th Street,north to Wirt Street,then west/northwest to the northwest corner of
the alley and Military Avenue between Spencer and Bedford Avenue, back southeast to Military Avenue/
Northwest Radial Highway,is hereby declared a blighted and substandard area in need of redevelopment,as
recommended by the Mayor.

Inter-Governmental Agreement
Between the
NEBRASKA DEPARTMENT OF ENVIRONMENTAL QUALITY
and
City of Omaha, Nebraska (Subrecipient)
Regarding Grant Award under the American Recovery
And Reinvestment Act (ARRA) of 2009 Nebraska Clean Diesel Program
THIS Inter-Governmental Agreement is made and entered into by and between the Nebraska
Department of Environmental Quality(NDEQ)and City of Omaha, Nebraska(Subrecipient), in
accordance with Nebr. Rev. Stat. Sec. 81-1504(Supp. 1997)of the Nebraska Environmental Protection
Act.
NOW,THEREFORE, the parties do hereby agree to the terms and conditions of this Inter-
Governmental Agreement as follows:
I. TERM OF INTER-GOVERNMENTAL AGREEMENT
This Inter-Governmental Agreement will remain in effect until all identified tasks are completed,
unless terminated under section II.Q, but will not remain in effect past September 30, 2010 unless
extended under section II.E.
II. CONDITIONS OF INTER-GOVERNMENTAL AGREEMENT
A. Work Description and Schedule
1. The Subrecipient agrees to purchase and install on city-owned vehicles low
rolling resistance tires, all per the Subrecipient's grant application, with a grant of
up to $33.236.00 for both equipment and installation of equipment
2. The Subrecipient's grant application is hereby incorporated by reference into this
Inter-Governmental Agreement. The Subrecipient agrees to complete the project
for which the grant is awarded in accordance with the project plan and budget
described in the grant application. The Subrecipient must demonstrate that they
selected the lowest and/or most cost-effective bid. The project must be
completed by August 31, 2010.
3. NDEQ agrees to reimburse Subrecipient an amount not to exceed $33,236.00,
including any revenue received by the Subrecipient under section II.D.2.b,
whichever is less.
4. Subrecipient is required to install tires.
B. Reimbursement of Grant Funds and Reporting Requirements
1. Subrecipient may request payment for equipment in advance of actual delivery of
equipment by submitting a copy of purchase orders or invoices to Gerry Allen,

the W-9 and ACH/EFT forms as soon as possible to facilitate payment.
D. Grant Conditions
1. The Subrecipient is required and hereby agrees to use, and require sub-
contractors to use, a federal immigration verification system to determine the
work eligibility status of new employees physically performing services within the
State of Nebraska. A federal immigration verification system means the
electronic verification of the work authorization program authorized by the Illegal
Immigration Reform and Immigrant Responsibility Act of 1996, 8 U.S.C. 1324a,
known as the E-Verify Program, or an equivalent federal program designated by
the United States Department of Homeland Security or other federal agency
authorized to verify the work eligibility status of a newly hired employee.
If the Subrecipient is an individual or sole proprietorship, the following applies:
a. The Subrecipient must complete the United States Citizenship
Attestation Form attached to this Inter-Governmental Agreement.
b. If the Subrecipient indicates on such attestation form that he or she is a
qualified alien, he or she agrees to provide the US Citizenship and
Immigration Services documentation required to verify lawful presence in
the United States using the Systematic Alien Verification for Entitlements
(SAVE) Program.
c. The Subrecipient understands and agrees that lawful presence in the
United States is required and the Subrecipient will be disqualified or the
Inter-Governmental Agreement terminated if such lawful presence
cannot be verified as required by Neb. Rev. Stat. §4-108
2. The following grant conditions shall be complied with by all Subrecipients of
federal grant funds.
a. The Subrecipient agrees to comply with all the following provisions; rules
and regulations (can be obtained from NDEQ):
(1) Office of Management and Budget Circulars A-102, A-133, A-87
and 40 CFR Parts 31, 32, and 35.
(2) Procurement standards of 40 CFR 31.32(g).
(3) Prohibitive lobbying 18 U.S.C. Section 1913, Section 607(a)of
Public Law 96.74, or Section 319 of Public Law 101-121.
(4) Federal Register, Vol. 53, No. 102, Debarment and Suspension
under EPA, Assistance Loan and Benefit Programs.
(5) Rules governing"Fair Share" of federal funds to Minority
Business Enterprises (MBEs),Women-owned Business
Enterprises (WBEs), Small Business Enterprises (SBEs), Small
Disadvantaged Businesses (SDBs), and Small Business in Rural
Areas (SBRAs). Affirmative steps outlined in 40 CFR 30.44, or
40 CFR 33.240, or 40 CFR 35.6580, or Section 129 of Public

reuse, the Subrecipient must provide an estimated value,
together with explanation of the basis for the estimate, of the
tire(s)and the cost share requirements and/or grant award shall
be adjusted accordingly.
c. DUNS Number. Subrecipient must obtain a DUNS number by calling 1-
866-705-5711 or at http://www.fedaov.dnb.com/webform/index.isp
DUNS number must be reported on every request for reimbursement,
every quarterly report and the final report.
d. Single Audits. In accordance with OMB Circular A-133, which
implements the single Audit Act, the Subrecipient hereby agrees to
obtain a single audit from an independent auditor if it expends$500,000
or more in total Federal funds in any fiscal year. Within nine months -
after the end of a Subrecipient's fiscal year or 30 days after receiving the
report from the auditor, the Subrecipient shall submit a copy of the SF-
SAC and a Single Audit Report Package.
e. Trafficking Victim Protection Act of 2000. Subrecipient and
Subrecipient's employees may not engage in severe forms of trafficking
in persons during the period of time that the award is in effect; procure a
commercial sex act during the period of time that the award is in effect;
or use forced labor in the performance of the award or subawards under
the award.
f. False Claim. Subrecipient must promptly refer to EPA's Inspector
General any credible evidence that a principal, employee, agent, sub-
grantee, sub-contractor, loan recipient, or other person has submitted a
false claim under the False Claims Act or has committed a criminal or
civil violation of laws pertaining to fraud, conflict of interest, bribery,
gratuity, or similar misconduct involving funds provided under this grant
or sub-grants awarded by the Subrecipient.
g. Limit on Funds. Subrecipient shall not use funds for particular activities
for any casino or other gambling establishment, aquarium, zoo, golf
course, or swimming pool.
h. OMB Guidance.This award is subject to all applicable provisions of
implementing guidance for the American Recovery and Reinvestment
Act of 2009 issued by the United States Office of Management and
Budget, including the Initial Implementing Guidance for the American
Recovery and Reinvestment Act(M-09-10) issued on February 18, 2009
and available on www.recoverv.00v, and any subsequent guidance
documents issued by OMB.
Recovery Act Logo. Subrecipient must display the American Recovery
and Reinvestment Act of 2009 logo in a manner that informs the public
that the project is a Recovery Act investment. Logo stickers will be
provided by NDEQ.
E. Amendments
This Inter-Governmental Agreement may be amended in writing at any time by mutual
agreement of the parties, except insofar as any proposed amendments are in any way
contrary to applicable law or requirements of the EPA or NDEQ.

L. Inspection of Premises
The duly authorized NDEQ representative shall have the right to inspect the project and
related records to assure compliance with the terms of this Inter-Governmental
Agreement during regular office hours.
M. Independent Subrecipient
The Subrecipient is and shall perform this Inter-Governmental Agreement as an
independent Subrecipient and as such shall have and maintain exclusive control over all
of its employees, agents and operations. Neither the Subrecipient nor any person
employed by the Subrecipient shall act, propose to act or be deemed the NDEQ's agent,
representative or employee. The Subrecipient assumes full and exclusive responsibility
for the payment of all premiums, contributions, payroll taxes and other taxes now or
hereafter required by any law or regulation and agrees to comply with all applicable laws,
regulations and orders relating to Social Security, Unemployment Compensation, OSHA,
affirmative action, equal employment opportunity and other laws, regulations and orders
of like nature. For any work hereunder subject to the Veterans Readjustment Assistance
Act of 1974, or the Rehabilitation Act of 1973, the parties hereto shall comply with all
provisions thereof, together with all applicable rules, regulations and orders of the
Department of Labor, and the notices required pursuant to 41 CFR 60-1.4, 60-250.4 and
60-741.4 which are hereby incorporated by reference into this Inter-Governmental
Agreement.
N. Nondiscrimination
•
The Nebraska Fair Employment Practice Act prohibits Subrecipients to the State of
Nebraska and their sub-contractors from discriminating against any employee, or
applicant for employment in the performance of such Inter-Governmental Agreements,
with respect to hire, tenure, terms, conditions or privileges of employment because of
race, color, religion, sex, disability or national origin. The Subrecipient's signature is a
guarantee of compliance with the Nebraska Fair Employment Practice Act, and breach of
this provision shall be regarded as a material breach of this Inter-Governmental
Agreement. The Subrecipient shall insert a similar provision in all sub-contracts for
services to be covered by any Inter-Governmental Agreement resulting from this Inter-
Governmental Agreement.
0. Drug Free Workplace •
The Subrecipient, by executing this Inter-Governmental Agreement, certifies and assures
that it operates a drug free workplace as addressed in the State of Nebraska Drug Free
Workplace Policy of July 7, 1989.
P. Publication Rights
All parties shall have publication and reproduction rights for all reports and materials,
which are produced as a result of this Inter-Governmental Agreement.

purchasing additional E85 and Compressed Natural Gas vehicles to further reduce the impact of the
. City's carbon footprint. This project not only aligns with the City's current strategies to minimize
diesel emissions, but also sets an example for future efforts.
2. Technology Employed by Project
Please provide a description of which technology will be employed in project(e.g.,diesel
oxidation catalysts,auxiliary power units, engine/vehicle replacements including
make/model/year).
The City of Omaha will purchase EPA verified low rolling resistant tires which are designed to improve
the fuel efficiency of a vehicle by minimizing the energy wasted on heat as the tire rolls down the
road.According to greenseal.org, 80 percent or more of a vehicle's fuel energy is wasted by friction
and other such losses. The City's proposed project is an effort to reduce this waste and increase the
fuel efficiency of the proposed vehicles. The City will purchase Bridgestone low rolling resistant tires,
as verified by the EPA, with the following specifications:

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City of Omaha submitted an application to the American
Recovery and Reinvestment Act of 2009, Nebraska Department of Environmental Quality,
Nebraska Clean Diesel Grant Program to purchase Environmental Protection Agency verified
low rolling resistance tires to reduce diesel emissions from city fleet vehicles, and;
WHEREAS, the Nebraska Department of Environmental Quality has awarded
$33,236 to the City of Omaha to purchase low rolling resistance tires to be installed on eleven
(11) city fleet vehicles as a match from the City of Omaha's Fleet Management Division by the
project deadline on August 31, 2010, and;
WHEREAS, the Mayor recommends the approval of and it is in the best interest
of the City of Omaha and the residents thereof to accept this grant award.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, as recommended by the Mayor this Council does hereby approve the
acceptance of the grant award in the amount of $33,236 from the American Recovery and
Reinvestment Act of 2009, Nebraska Department of Environmental Quality, Nebraska Clean
Diesel Grant Program to purchase Environmental Protection Agency verified low rolling
resistance tires to reduce diesel emissions from eleven (11) city fleet vehicles. Installation of the
tires will be provided as a match by the City of Omaha's Fleet Management Division by the
project deadline on August 31, 2010.
