• The attached Resolution has been prepared at the request of the City Clerk. The Resolution consents
to the NAIFA-Nebraska Foundation (Nebraska Association of Insurance and Financial Advisors)
holding a lottery within the City beginning February 18, 2010. The winners will be drawn May 14,
2010.
State law requires that organizations conducting certain raffles or lotteries within a metropolitan
class city must obtain a permit from the state and get specific authorization from the city. The City
Council has passed a general resolution consenting to raffles and lotteries by any business with its
principal place of business within the City. The NAIFA-Nebraska Foundation is based in Lincoln
and does not meet this standard;therefore,it has requested this specific authorization for its lottery.

Mr. Brown:
The NAIFA-Nebraska Foundation, a not-for-profit charitable foundation, collecting and
administering charitable funds under section 501 (c) (3) of IRS tax code, was established in 1984,
and their office is in Lincoln. They are planning a statewide lottery to raise money to support their
mission to inform and educate the general public regarding the benefits of life insurance and
closely related financial products. Their bylaws state that "The Corporation shall have one or more
classes of members, who shall have contributed financially to the corporation." Over 250
individuals, families and corporations have contributed to the Foundation.
The Foundation requests authorization to conduct the lottery inside Omaha beginning February 18.
The winners will be drawn May 14.
Will this be on the agenda for the February 9 City Council meeting? If authorized, do you inform us
by email?

. RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Nebraska statutes prohibit any person from conducting a lottery, the gross
proceeds of which exceed$1,000,or a raffle,the gross proceeds of which exceed$5,000,within the
corporate limits of the City of Omaha without first receiving the City's specific authorization;'and,

WHEREAS,organizations mayobtain a permit from the state to conduct raffles and lotteries

with gross proceeds exceeding those amounts; and,
WHEREAS, pursuant to section 9-433(2) of the.Nebraska statutes the NAIFA-Nebraska
Foundation of Lincoln,Nebraska,has requested the City allow it to hold a lottery within the City of
Omaha beginning February 18, 2010, with the winners being drawn on May 14, 2010; and,
WHEREAS,the City Council of the City of Omaha wishes to allow the NAIFA-Nebraska
Foundation to conduct this lottery within the City of Omaha in accordance with state law.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF
OMAHA:
THAT, the NAIFA-Nebraska Foundation is hereby authorized to conduct one (1) lottery
within the City of Omaha beginning February 18,2010,with the winners being drawn May 14,2010,
in,accordance with any permits or conditions required or imposed by state law.
