It has come to my attention that your term of appointment to the Omaha Housing Authority Board was
erroneously calculated. Your term actually expired in June of 2010. Per State law, you were to fill the
unexpired term of the person you replaced (City Councilmember Frank Brown) whose term was from
June 7, 2005 to June 7, 2010.
I want to thank you for your service to your City. It is my intention to appoint a new person to your seat.
In the meantime the seat will remain vacant until I have completed the process of appointing a new
person and this appointment is approved by the Omaha City Council.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, pursuant to the provisions of the Nebraska Housing Agency Act,
Nebraska statutes sections 71-1572 et seq.,as amended,and Omaha Municipal Code sections 2-231
and 232, the City of Omaha has created a Housing Authority; and
WHEREAS, as directed by those provisions,it is the responsibility of the Mayor to
appoint and submit for confirmation the names of persons to serve as Commissioners on the
governing body of the Omaha Housing Authority; and,
WHEREAS, section 71-15,103 (Reiss. 2009) directs that a.rnember of the Omaha
City Council may be appointed as a Housing Authority Commissioner representing the City of
Omaha to serve not longer than that person's service on the City Council and, pursuant to that
authority,City Councilmember Frank Brown was appointed and confirmed as a Commissioner for a
term commencing in June, 2005, and extending not longer than five (5) years, contingent on
continued service as a City Councilmember; and,
WHEREAS, when Frank Brown resigned his position on the Commission prior to
expiration of his term and subsequently ended his service as an Omaha City Councilmember,Mr.
Tony Welchen was appointed and confirmed as a Commissioner in March,2007,to a specified term
extending beyond the vacancy created by Mr. Brown's resignation; and,
WHEREAS, because Tony Welchen was not then and is not now a member of the
Omaha City Council,his appointment to fill the vacancy as a representative of the City Council was
in error; and,
WHEREAS, because Tony Welchen was appointed for a specified length of time
extending beyond the vacancy created by Mr. Brown's resignation, the term specified in the
appointing resolution was in error and contrary to section 71-1599(Reiss.2009),which directs that
all vacancies shall be filled for the"unexpired term"; and,
WHEREAS,after review and careful consideration,Mayor Jim Suttle has determined
that, in accordance with the laws of the State of Nebraska and the City of Omaha, the term of Mr.
Tony Welchen as a Commissioner of the Omaha Housing Authority expired on June 7, 2010; and,

that these previous errors in the appointment of Mr.Tony Welchen create serious legal questions that
may affect the ability of the Omaha Housing Authority to properly carry out its important mission of
providing decent,safe,sanitary,and affordable housing for many citizens of the City of Omaha and,
for that reason,the errors must be and should be immediately corrected to comply with the governing
statutes; and, •
WHEREAS,after review and careful consideration,Mayor Jim Suttle has determined
that City Councilmember Ben Gray should be appointed as a Commissioner to the Omaha Housing
Authority representing the City of Omaha and serving a term not to exceed five years,commencing
upon confirmation by the City Council.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY.
