Transmitted herewith is a resolution accepting and concurring with a bid award by the State of
Nebraska Department of Roads (NDOR) for the construction of intersection safety
improvements, for the intersection of 66th Street and Maple Street, known as OPW 51544.
The City Council approved an Agreement with NDOR by Council Resolution.No. 1228 on
September 9, 2008 for Federal Aid Project HSIP-5039(1), State Control No. 22356 which is for
intersection safety improvements, including nodes to corners and traffic signal modifications for
the intersection of 66'n Street and Maple Street. NDOR received bids for this project on October
21, 2010 and is recommending award to the lowest bidder, Navarro Enterprise Construction Inc.,
Omaha, Nebraska, in the amount of$78,622.85. 90% of the cost of this project is covered by
Federal and State funds with Omaha's 10% participation of$7,862.29 paid from the Street and
Highway Allocation Fund 12131, Traffic Capital Organization 116189, in accord with the
approved program agreement with NDOR for the project. NDOR is also asking the City Council
to concur with this bid award by approval of the attached resolution.

Resolution.

THIS SUPPLEMENTAL AGREEMENT, made and entered into by and between the City
'of Omaha, hereinafter referred to as the"LPA", and the State of Nebraska Department of Roads,
hereinafter referred to as the"State", and hereinafter referred to collectively as the"Parties".
WITNESSETH:
WHEREAS,the Parties have previously entered into a Program Agreement, BL1082,
executed by the City on November 9, 2010 and executed by the State on November 17, 2010,
hereinafter referred to as the"Original Agreement" providing for the construction of Project No.
HSIP-5039(1), and
• WHEREAS, it is the desire of the City that this project be constructed under the
designation of Project No. HSIP-5039(1)as evidenced by the resolution of the City dated the
q day of klMIEµ1Q , 2010, attached and identified as Exhibit"A"and made a part of
this agreement.
WHEREAS,the LPA desires to perform professional engineering services for the above
named project utilizing their own staff, and
WHEREAS,the LPA staff has met all requirements of the Nebraska Board of Engineers
and Architects to provide professional services for this project, and
WHEREAS,the LPA will not seek reimbursement for this work from Federal funds made
available for this project, and
WHEREAS,the LPA will be contracting with a Consultant to perform materials testing for
this project, and
WHEREAS, LPA is willing to perform the services in accordance with the terms
hereinafter provided, agrees to comply with all federal, state, and local laws and ordinances
applicable to this agreement, and agrees to comply with all applicable federal-aid transportation
related program requirements, so that LPA's project will be fully eligible for federal
reimbursement and
NOW THEREFORE, in consideration of these facts,the parties agree as follows:

SECTION 1. The LPA agrees to provide construction engineering services for the above named
project utilizing their own staff. The project shall be designed in accordance with the
requirements of Section 13 in the Original Agreement.
SECTION 2. The LPA will not seek reimbursement from Federal funds for the construction
engineering services performed by their own staff or consultants contracted to perform services
on behalf of the LPA.
SECTION 3. The LPA understands and agrees that the LPA, its RC, agents and Contractor have
the sole duty of proper prosecution of the project, in accordance with the approved plans, and
that failure to properly prosecute and construct the project in accordance with the approved plans
may result in the loss of federal funding.
SECTION 4. The LPA must follow all guidelines and requirements outlined in the LPA
Guidelines Manual when selecting a Consultant to provide services for the project. To maintain
Federal-aid eligibility for the project,the selected Consultant must be a State Certified
Consultant. The Consultant will perform the work that is stipulated in Exhibit"B",which is
attached and hereby made a part of this supplemental agreement.
SECTION 5. Because the LPA is to receive Federal Funds for any part of this project,the LPA
agrees to perform the services for all phases of work according to Federal, State and local laws
and ordinances applicable to this agreement and agrees to comply with all applicable federal-aid
transportation related program requirements.
SECTION 6. The parties agree that,except as specifically amended by the Supplemental
Agreement, all terms and provisions of the Original Agreement, BL1082,for Project No. HSIP-
5039(1), executed by the City on November 9, 2010 and executed by the State on November 17,
2010 shall remain in full force and effect.
IN WITNESS WHEREOF,the LPA and State hereto have caused these presents to be
executed by their proper officials thereunto duly authorized as of the dates below indicated.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council approved an Agreement with the State•of Nebraska •

finance its share of the cost of construction of this project identified as Federal Aid Project HSIP=5039(1),
State Control No. 22356 and OPW 51544, and that the City of Omaha would pay costs as set forth in the
agreement; and,
WHEREAS, the State and the City received bids for the construction of this project on
October 21,2010, at which time five bids were received for the construction of the proposed work; and,
WHEREAS, the following contractor has been selected by NDOR as the low bidder to
whom the contract should be awarded: Navarro Enterprise Construction Inc., Omaha, Nebraska for the
sum of$78,622.85; and,
WHEREAS, 90% of the cost of this project is covered by Federal and State funds with
Omaha's 10% participation of $7,862.29 paid from the Street and Highway Allocation Fund 12131,
Traffic Capital Organization 116189, in accord with the approved program agreement with NDOR for the
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the City Council concurs with the bid award to
Navarro Enterprise Construction Inc. for the project identified.as Federal Aid Project HSIP-5039(1), State
Control No. 22356 and OPW 51544, being intersection safety improvements, including nodes to corners
and traffic signal modifications for the intersection of 66th Street and Maple Street, in the amount of
$78,622.85,with 90%of the contract cost being paid by Federal and State funds and the City's 10% share
in the amount of $7,862.29 being paid from the Street and Highway Allocation Fund 12131, Traffic
Capital Organization 116189, in accord with the approved program agreement with NDOR for the
project.
BE IT FURTER RESOLVED THAT:
THAT, the City Council hereby authorizes the Mayor and the City Clerk to sign the
construction contract on behalf of the City of Omaha, and that the Mayor and the City Clerk are also

The Schemmer Associates Inc.(Schemmer)proposes to render construction materials testing
services to the City of Omaha(Owner)during construction of OPW 51544 project,located at
660i and Maple Streets in Omaha,Nebraska. The development of this scope of services and
compensation proposal is based in part on the following:
➢ Review of project plans and specifications.
I. APPROACH TO MATERIALS TESTING SERVICES
Schemmer proposes to provide construction materials testing in accordance with the project
specifications,ASTM standards,and the NDOR Materials and Sampling Guide. Below is a
detailed description of the activities Schemmer intends to perform.
A. Earthwork!Structural Fill
Laboratory tests will consist of soil moisture—density relationships(Proctor tests)and
classification tests to determine compliance with specifications. Gradation tests will be
performed on pipe bedding aggregates. During earthwork operations,Schemmer will
perform compaction testing for storm sewer and retaining wall backfill. We will test
density for subgrade preparation of pavement.

B. Cast in Place Concrete
Schemmer will perform field testing of cast-in-place Portland cement concrete for
retaining walls and pavement. Concrete field testing includes casting concrete cylinder
specimens for laboratory strength testing,slump,air content,and temperature
measurements. Per NDOR requirements,we will perform plant inspections and related
testing prior to each concrete placement(sidewalks excluded as small quantity/non
critical item). We will perform a gradation test on one sample each of course and fine
aggregate used in the concrete and a split sample will be delivered to NDOR for

We are providing a full estimate of the materials testing quantities and costs. The type of test,
specification requirement,and estimated quantities are provided in attached Table 1. Our
schedule of unit prices with estimated total cost based on the quantities from Table 1 is provided
in attached Table 2. The estimated test quantities were determined based on past experience
under normal construction conditions. Quantities may vary from the numbers of units estimated
in this proposal.
II. LABORTORY QUALIFICATIONS
Schemmer has been in business for over 50 years providing engineering and architectural
design services. Schemmer is headquartered In Omaha with offices in Lincoln and Council
Bluffs. Schemmer has a full construction material testing laboratory located in the Council Bluffs
office.Our testing and inspection services include oversight by a Professional Engineer licensed
in the State of Nebraska. Schemmer's laboratory is certified with the US Army Corps of
Engineers and Nebraska Department of Roads for the required tests and maintains calibrations
and equipment as required by this certification and applicable ASTM standards.We regularly
conduct testing of standardized proficiency samples. Schemmer meets the requirements as set
forth by ASTM C1077 and E329. Our laboratory certifications are attached.
III. ORGANIZATION OF TESTING TEAM
A. Lead Geotechnical Engineer •
Loras Klostermann,P.E.,will be the lead geotechnical engineer for the project. Loras
' will provide on site observations and recommendations as required by project
documents. Loras will also provide testing oversight and project management review.
Loras has been a geotechnical engineer for over 25 years and has worked on a variety
of similar projects.
B. Lead Site Inspector
Jonathon Goldie,E.I.,will be the senior technician for the project performing the majority
of the special inspections and material tests. Jonathon has a B.S.degree in engineering
and possesses ICC certifications in reinforced concrete,structural masonry,and
structural steel welding and bolting inspection. Jonathon also has ACI certifications for
field testing technician and laboratory strength testing technician.
C. Assisting Technicians •
Adam Sleeper,P.E.,will provide assistance for testing and inspections when needed.
He recently received his professional engineer license for civil engineering with
emphasis in construction. He also possesses ACI field testing technician certification.
Our services will be provided on a 24-hour notice"will-call"basis,coordinated by your on-site
representative or the subcontractor responsible for the work to be tested. Properly trained and
certified personnel will be dispatched to fulfill you testing needs.

IV. COMPENSATION
Our client will be invoiced monthly only for the actual amount of work performed. The unit rates
listed in table 2 at the end of this proposal will be used for the duration of the project. Time is
included in each unit rate for entering data in site manager.
A. Construction Materials Testing Services: Schemmer has estimated the number of
tests necessary and the amount of personnel time to perform the estimated scope of
services provided above. Schemmer estimates our total testing and inspection fee for
the subject project will be Four Thousand, Six Hundred Eighty-Five Dollars and No
Cents ($4,685.00) in accordance with the terms of the attached General Conditions
and Supplemental General Conditions.
B. Additional Services: Additional Services as approved and directed by you will be
rendered by The Schemmer Associates Inc.on a unit rate basis in accordance with
our current standard Geotechnical Services price schedule for services accrued to the
project,plus Consultant Costs based on time and materials basis(if any),plus
Reimbursable Expenses for such services.
C. Retesting Services: The contract documents provide provisions requiring the
retesting of materials that previously failed to meet the project specifications. It is
implied by the contract documents that cost of the retesting of failed work is
authorized. Retests of unsatisfactory work are considered additional services in
addition to the estimated fee provided in Section A of Compensation in this proposal.
It is not possible to estimate the number of retests that might be necessary.
VI. SCHEDULE
Schemmer shall commence the construction materials testing services on the project in
accordance with the project schedule after receipt of Notice-to-Proceed.
If the foregoing is agreeable,please indicate your acceptance by signing and returning one copy
of this proposal. We will consider the signed proposal an Agreement between the City of
Omaha and The Schemmer Associates Inc.for the services described herein.

RESOLUTION•
WHEREAS, there has been signed by the City of Omaha on the
11th day of September , 2008 , and the State on the 28th day of
September , 2008 , an agreement providing for the construction of a Federal
Aid Project at the following location: at the intersection of 66th and Maple.
, and
WHEREAS, in the above agreement, the City has pledged sufficient funds to finance its share of
the cost of the construction of this project identified as HSIP-5039(1) , and
WHEREAS, the above mentioned agreement provided that the City would pay costs as set forth
in the agreement, and
WHEREAS, the State and the City received bids for the construction of this project on
October 21, 2010 , at which time five bids were received for the construction of the
proposed work, and
WHEREAS, the following contractor(s) has been selected as the low bidder to whom the
contract(s) should be awarded:
Navarro Enterprise Construction Inc.; Omaha, Nebraska
Concrete Pavement, Culverts and General Items: $78,622.85
NOW THEREFORE, in consideration of the above facts, the City Council of the City of
Omaha , by this resolution, takes the following official action:
1. The Council hereby concurs in the selection of the above mentioned contractor(s) to whom the
contract(s) should be awarded.
2. The Council does not desire to perform any of the work with its own forces in lieu of performing
the work by the contract method.
3. The Council hereby authorizes the Mayor and the City Clerk of Omaha
to sign the construction contract on behalf of said City.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council approved an Agreement with' the State of Nebraska
Department of Roads (NDOR) by Council Resolution No. 1228 on September 9, 2008 for Federal
Funding for intersection safety improvements, including nodes to corners and traffic signal modifications
for the intersection of 66th Street and Maple Street; and,
WHEREAS, in the above agreement the City of Omaha has pledged sufficient funds to
finance its share of the cost of construction of this project identified as Federal Aid Project HSIP-5039(1),
State Control No. 22356 and OPW 51544, and that the City of Omaha would pay costs as set forth in the
agreement; and,
WHEREAS, the State and the City received bids for the construction of this project on
October 21, 2010, at which time five bids were received for the construction of the proposed work; and,
WHEREAS, the following contractor has been selected by NDOR as the low bidder to
whom the contract should be awarded: Navarro Enterprise Construction Inc., Omaha, Nebraska for the
sum of$78,622.85; and,
WHEREAS, 90% of the cost of this project is covered by Federal and State funds with
Omaha's 10% participation of $7,862.29 paid from the Street and Highway Allocation Fund 12131,
Traffic Capital Organization 116189, in accord with the approved program agreement with NDOR for the
project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the City Council concurs with the bid award to
Navarro Enterprise Construction Inc. for the project identified as Federal Aid Project HSIP-5039(1), State
Control No. 22356 and OPW 51544, being intersection safety improvements, including nodes to corners
and traffic signal modifications for the intersection of 66th Street and Maple Street, in the amount of
$78,622.85, with 90%of the contract cost being paid by Federal and State funds and the City's 10% share
in the amount of $7,862.29 being paid from the Street and Highway Allocation Fund 1213,1, Traffic
Capital Organization 116189, in accord with the approved program agreement with NDOR for the
project.
BE IT FURTER RESOLVED THAT:
THAT, the City Council hereby authorizes the.Mayor and the City Clerk to sign the
construction contract on behalf of the City of Omaha, and that the Mayor and the City Clerk are also
authorized to sign_the attached NDOR documents.
