The original Engineering Agreement with Tetra Tech was approved by Council Resolution No. 230 on March 10, 2009. The attached Amendment to the Agreement authorizes Engineering Technologies, Inc., to be utilized as a sub-consultant to provide additional engineering services for the electrical engineering of this project. The exact scope of services is included in Exhibit A in the attached Amendment. Engineering Technologies, Inc. has agreed to perform the services needed as a sub-consultant as detailed in the attached Amendment No. 2 to the Agreement, which by this reference is made a part hereof, for an additional fee of $8,000 to be paid from Stormwater Management Plan Fund 12143, Stormwater Management Plan Organization 128026. 100% of this fee will be reimbursed by the City of Carter Lake in accord with the Interlocal Agreement for design and construction of the Lake Level Control Facilities. Tetra Tech, Inc. and Engineering Technologies, Inc. have filed the required Annual Contract Compliance Report, Form, CC-1, in the Human Rights and Relations Department. We would expect to start our services promptly after receipt of your acceptance of this proposal and to complete our services within a mutually agreed upon time frame. Liability Both parties recognize the risks,rewards, and benefits of the Project as they relate to our fee for services. The risks have been allocated such that,to the fullest extent permitted by law, our total liability for any and all injuries, claims, losses, expenses, damages, or claims expenses arising out of this agreement from any cause(s), shall not exceed the total amount of$250,000.
