Mark VII Enterprises Inc is in receipt of you're letter (attached) regarding the above referenced matter and
provide the following considerations.
After further investigation into this matter, it is our understanding that the reason our bid was deemed non
compliant with the Small & Emerging Small Business requirements is because our sealed bid package failed to
include; EXHIBIT "A" SMALL AND/OR EMERGING SMALL BUSINESS DISCLOSURE PARTICIPATOIN
FORM... which in and of itself is correct however, we did include our CERTIFICATION FOR TIER I
EMERGING SMALL BUSINESS certification of award (attached)form with effective dates of 6/22/10 thru
6/22/2013 which includes our NAICS Codes that are consistent with the set aside work scopes and thereby
verifying our alignment with the specification criteria. That said, we respectfully submit this letter as our notice
of appeal.
Furthermore and relevant to this case... we are most grateful for the opportunities the Tier I & II ESB &/or SB
program provides however, in it's current state, the program only recognizes "Subcontractors" as a set aside
class and does not provide equal opportunities to "General Contractors" and/or"Construction Management"
firms like ours which are also certified and participating concerns in the program.
In accord with Section 10-110 OMC this shall serve as notice. Please proceed accordingly.

Section 10-110 of the Omaha Municipal Code allows a Departmental Director to reject bids
because items on the bid received were non-compliant with the specifications. This letter is to
serve as written notice that your bid for Project OPW 52130-SP, Fire Station #42 Generator
Installation was rejected for the following reason:
• The bid was not compliant with the Small &Emerging Small Business requirements.
The Public Works Department appreciates your interest and participation in the bidding process.
Section 10-110 OMC also provides that: "Within ten (10) days after a bid is rejected, any
rejected bidder may appeal to the city council by filing with the city clerk a written objection
stating all the reasons for the objection."
