Transmitted herewith is a Resolution approving a three change orders for OPW 51856, which is
the Pacific Pointe Basin 'A' Closure and Outlot 'A' Pond Expansion Plan, located at 192'
Avenue. Resolution No. 1093 on September 21, 2010 approved Swain Construction, Inc. as low
bidder for this project. This change order authorizes additional expenses for additions to the
project not anticipated in the original design.
Swain Construction, Inc. has agreed to perform the additional work for a fee of $289,971.80.
The Change Order contains the details of the additional work. All other provisions of the
original contract shall remain in full force and effect. The costs incurred will be paid from the
2006 Environment Fund 13122, 2011. Issue Transportation Bond Organization 117216, year
2011 expenditure.
The Public Works Department requests your consideration and approval of the attached
Resolution and Change Order.

Commonwealth of Pennsylvania, United States of America. The parties further agree to submit to
the jurisdiction of both the state and federal courts of the Commonwealth of Pennsylvania.
14. Non Disclosure-With exception for the existence of this Contract,the parties hereby
agree that neither party shall disclose to any third party the contents of this Contract without the
prior written approval of the other party except as may be required in the performance of this

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Swain Construction, Inc. was awarded a contract by City Council
Resolution No. 1093 on September 21, 2010, to construct OPW 51856, being Pacific Pointe
Basin 'A' Closure and Outlot 'A' Pond Expansion Plan, located at 192nd Avenue; and,
WHEREAS, it is necessary to add items not originally anticipated in the specifications
for the project; and,
WHEREAS, Swain Construction, Inc. has agreed to perform the services listed in the
attached Change Orders No. 1 through 3, which by this reference is made a part hereof, for an
additional total cost of$289,971.80, which will be paid from the 2006 Environment Fund 13122,
2011 Issue Transportation Bond Organization 117216, year 2011 expenditure.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, Change Orders No. 1 through 3 for Swain
Construction, Inc. to construct the necessary modifications to OPW 51856 being Pacific Pointe
Basin 'A' Closure and Outlot 'A' Pond Expansion Plan, located at 192nd Avenue, is hereby
approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to pay an additional $289,971.80 for these
changes from the 2006 Environment Fund 13122, 2011 Issue Transportation Bond Organization
117216, year 2011 expenditure.

13. Construction—This Contract shall be interpreted in accordance with the plain English
meaning of its terms, and the construction thereof shall be governed by the laws of the
Commonwealth of Pennsylvania, United States of America. The parties further agree to submit to
the jurisdiction of both the state and federal courts of the Commonwealth of Pennsylvania.
14. Non Disclosure-With exception for the existence of this Contract,the parties hereby
agree that neither party shall disclose to any third party the contents of this Contract without the
prior written approval of the other party except as may be required in the performance of this
Contract.
