Because of a work conflict I will not be able to personally attend the City Council meeting on Tuesday May 24, 2011 and ask that the Council consider my opposition. I remain opposed to the issuance of this special use permit since it would interfere with my easement that I have held for THIRTY (30) YEARS. I have confirmed with Lewis Surveying and Attorney Thomas Penke that I have an indiscriminate easement across the parking area where Agarwal wants to build storage buildings. Your approval of this special use permit would eliminate my ability to use this easement that I have used for Thirty (30) years. I met with Arun Agarwal approximately two (2) years ago and he told me that "he did not need my property". He has NOT made me any other offers nor has he attempted to resolve this easement issue. The Planning Board recommended approval only if the easement issue was resolved and it never has been. I drive a tractor trailer and have parked it for years on the Ames Plaza parking lot that is east of my home. I have a recorded easement that allows me to do so and had it examined by two(2) lawyers who agree. I am all for the new development of the Ames Plaza but need to have my easement. The planning board approved a Special Use Permit with the condition that before it was approved by the City Council that my access easement would be resolved. Yet it was taken before the council and passed and I was never satisfied regarding my easement. Now I understand that it is going before the City Council again and still my access easement has not been satisfied. How is it possible to say in black and white from the Planning Board that before it can go to City Council that the access easement must first be resolved and yet no one bothers to address that point. How do things like this happen? I would like for the City Council person in my district to call me at my cell number and explain why no one followed the decision of the Planning Board.
