Transmitted herewith is a resolution accepting and concurring with a bid award by the State of
Nebraska Department of Roads (NDOR) for improvements to the intersection of 19th Street and
Howard Street, using Federal and State aid, Project OPW 51403.
The City Council approved an Agreement with NDOR by Council Resolution No. 257 on March
15, 2011 for Federal Aid Project HSIP-5091(2), State Control No. 22354. NDOR received bids
for this project on. July 21, 2011 and is recommending award to the lowest bidder, U.S. Asphalt
Co., Omaha, Nebraska in the amount of$128,664.24. 90% of the cost of this project will be paid.
by Federal funds and the City's 10% remaining share of$12,866.42 being paid from the Street
and Highway Allocation Fund 12131, Traffic Capital Organization 116189 in accord with the
approved program agreement with NDOR for the project. NDOR is also asking the City Council
to concur with this lid award by approval of the attached resolution.
The Public Works Department requests your consideration and approval of the attached
Resolution.

RESOLUTION
WHEREAS, there has been signed by the City of Omaha on the
17 day of March , 2011 , and the State on the 1 day of
April 2011 an agreement providing for the construction of a Federal
Aid Project at the following location: improvements to the intersection of 19th and Howard Streets and
resurfacing 19th Steet from Saint Mary's Avenue to Harney Street
, and
WHEREAS, in the above agreement, the City has pledged sufficient funds to finance its share of
the cost of the construction of this project identified as HSIP-5091(2) , and
WHEREAS, the above mentioned agreement provided that the City would pay costs as set forth
in the agreement, and
WHEREAS, the State and the City received bids for the construction of this project on
July 21, 2011 , at which time 1 bids were received for the construction of the
proposed work, and
WHEREAS, the following contractor(s) for the items of work listed has/have been selected as the
low bidder(s)to whom the contract(s) should be awarded:
US Asphalt Co, Omaha, NE
Bituminous: $128,664.24
NOW THEREFORE, in consideration of the above facts, the City Council of the City of
Omaha , by this resolution, takes the following official action:
1. If for any reason the Federal Highway Administration rescinds, limits its obligations, or defers
payment of the Federal share of the cost of this project, the City hereby agrees to provide the
necessary funds to pay for all costs incurred until and in the event such Federal funds are allowed and
paid.
2. The Council hereby concurs in the selection of the above mentioned contractor(s) for the
items of work listed, to whom the contract(s) should be awarded.
3. The Council hereby authorizes the Mayor to sign the contract(s) with the above mentioned
Contractor(s)for the above mentioned work on behalf of the City.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council approved an Agreement with the State' of Nebraska
Depaitinent of Roads (NDOR) by Council Resolution No. 275 on March 15, 2011 for Federal;Funding
for improvements to the intersection of 19th Street and Howard Street, project identified,as Federal Aid
Project HSIP-5091(2), State Control No. 22354,and OPW 51403; and,
WHEREAS, the State received bids for the construction of this project on July 21, 2011,
at which time two bids were received for the construction of the proposed work, with the following
contractor selected by NDOR as the low bidder to whom the contract should be awarded: U.S. Asphalt
Co., Omaha,Nebraska, for the sum of$128,664.42; and,
WHEREAS, 90% of the eligible costs of this project will be paid by Federal funds and
the City's 10%remaining share of$12,864.42 will be paid from the Street and Highway Allocation Fund
12131,Traffic Capital Organization 116189, in accord with the approved program agreement with NDOR
for the project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the City Council concurs with the bid award to
U.S. Asphalt Co., Omaha,Nebraska, for the project identified as Federal Aid Project HSIP-5091(2), State
Control No. 22354, and OPW 51403, being improvements to the intersection of 19th Street and Howard
Street, in the amount of$128,664.24; with the City's 10% local share of$12,866.42 being paid from the
Street and Highway Allocation Fund 12131, Traffic Capital Organization 116189, in accord with the
approved program agreement with NDOR for the project.
BE IT FURTER RESOLVED THAT:
THAT, the City Council hereby authorizes the Mayor and City Clerk to sign the
construction contract on behalf of the City of Omaha, and that the Mayor and City Clerk are also
authorized to sign the attached NDOR documents.
