Jim Suttle,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving an Amendment to an Engineering Agreement with Alfred Benesch & Company to provide additional professional engineering services in regards to asphalt materials testing, inspection and project management on residential street resurfacing and rehabilitation and Americans with Disabilities Act (ADA) compliance projects in the City of Omaha. The original Engineering Agreement was approved by Council Resolution No. 144 on February 8, 2011. The attached Amendment to the Agreement authorizes Alfred Benesch & Company, to provide additional engineering services needed for the completion of these resurfacing projects. The exact scope of services is included in the attached Amendment. Alfred Benesch & Company has agreed to perform these services for a fee of $156,000, which is payable from the 2006 Transportation Bond Fund 13182, 2011 Issue Transportation Bond Organization 117116. Alfred Benesch & Company has filed the required Annual Contract Compliance Form, CC-1, in the Human Rights and Relations Department. The Public Works Department requests your consideration and approval of the attached Resolution and Amendment to the Engineering Agreement. WHEREAS the City desires the Consultant to amend the Engineering Agreement for Design Services for Asphalt Materials Testing, Inspection, and Project Management, City of Omaha 2011 Resurfacing Program project which was entered into on February 8, 2011 (Resolution 144) hereinafter called existing Agreement. NOW THEREFORE it is hereby agreed that the existing Agreement be amended as follows: 1. The existing Agreement shall be amended to include additional engineering work as outlined in the attached letter dated 8/16/2011. 2. The fee will consist of a compilation of estimated direct salary costs, direct non-salary costs, indirect salary costs, indirect non-salary costs and direct salary payroll additives levied under the terms of the original agreement. 3. This modification will increase the existing agreement by $156,000. This AMENDMENT shall be deemed a part of and subject to all terms and conditions of the existing Agreement. Except as modified above, the existing agreement shall remain in full force and effect. Specific engineering support services provided include pavement surveys, data gathering and processing associated with past,existing,and planned maintenance efforts directed at pothole repair and panel replacement activities. The following generally identifies the specific services requested: • Visual surveying and documenting number and approximate size of completed pothole repairs on collector and arterial street segments identified by City staff in all City Maintenance Districts. • Compiling data on a per District,per segment basis in tabular format and provide electronic files for the City's use. • Attending meetings with City staff and FEMA representatives to identify data to be compiled and processes to be used to satisfy documentation requirements. • Reviewing pothole repair records provided by the City and compile summary data identifying total labor hours and costs,total equipment hours and rates,material quantities and costs,and other related quantities and costs associated with pothole repair efforts within a time period to be specified by the City. • Providing on-call observation services consisting of providing construction observers to identify potholes to repair and observe and document the repair crew activities. It is anticipated that a single observer will simultaneously handle multiple crews in the same general vicinity as identified by the City. • All information compiled shall become the property of the City upon completion of this effort. • Visual surveying of concrete street segments identified by the City to assess patching needs • Compiling data on each concrete street segment surveyed to identify size and location of distressed panels We will utilize several Benesch staff members to provide these services and the compensation for services will be in accordance with the rate schedule established in our professional services contract for the 2011 Resurfacing Program projects. We estimate the total hours associated with the services identified above with this effort is approximately 2,200 hours and the fee associated is$156,000. We will separately document the hours and fee associated with this effort in our invoices for our 2011 Resurfacing work should an increase in the not to exceed amount be required in the future.
