Transmitted herewith is a resolution accepting,and concurring with a bid award by the State of
Nebraska Department of Roads (1 1'DOR) for Omaha Concrete Repair, Pkg. 2, known as Project
OPW 52100. I
The City Council approved an Agreement with NDOR by Council Resolution No. 573 on May
10, 2011 for Federal Aid Project MAPA-5026(14), State Control No. 22499, which includes
removal and replacement of deteriorated concrete panels on surface streets in various locations
within the City of Olnaha. Tie project also involves repair of adjacent sidewalks and drives, as
well as adjustment to grade of sewer manholes, utilities and inlets within repaired panels along
the project areas identified in the approved Program Agreement.
NDOR received bids for'this project on November 17, 2011 and is recommending award to the
lowest bidder, Navarro Enterprise Construction, Omaha, Nebraska, in the amount of
$1,158,362.73. Apiroximately 80% of the eligible costs of this project are covered by Federal
funds leaving Omaha's local share of $243,256 to be paid from the 2006 Transportation Bond
Fund 13182, 2010 Issue Transportation Bond Organization 117115, in accord with the approved
program agreement with NDOR for the project. NDOR is asking the City Council to concur
with this bid award by approval of the attached resolution.
Navarro Enterprise Construction has filed the required Annual Contract Compliance Report,
Form CC-1, in the Human Rights and Relations Department.
The Public Works Department requests your consideration and approval of the attached
Resolution.

prepared by counsel for one of the parties, the parties confirm that they and their respective
counsel have reviewed, negotiated and adopted this Agreement as the joint agreement and
understanding of the parties. This Agreement is to be construed as a whole and any presumption
that ambiguities are to be resolved against the primary drafting party shall not apply.
(j) No Waiver. Except as expressly provided in this Agreement, the failure of a party to act upon
a default of another party in any term,condition or obligation or other provision of this Agreement
shall not be deemed a waiver of any subsequent breach or default of the term, condition or
obligation or other provision by such defaulting party.
(k) Survival. Whether or not expressly stated in this Agreement, and whether or not the Closing
shall occur, all provisions in this Agreement shall survive the conveyance of the City Property to
City and, if occurring, the Closing as may be necessary in order to give full force and effect to this
Agreement. The provisions of this Paragraph 8(j) shall survive the conveyance of the City
Property to City and, if occurring,the Closing.

RESOLUTION•
WHEREAS, there has been signed by the City of Omaha on the
• 12th day of May , 2011 , and the State on the 3rd day of
June 2011 , an agreement providing for the construction of a Federal
Aid Project at the following location: Concrete repair in various locations in Omaha
•
, and
WHEREAS, in the above agreement, the City has pledged sufficient funds to finance its share of
the cost of the construction of this project identified as MAPA-5026(14) , and
WHEREAS, the above mentioned agreement provided that the City would pay costs as set forth
in the agreement, and
WHEREAS, the State and the City received bids for the construction of this project on
November 17, 2011 , at which time 6 bids were received for the construction of the
proposed work, and
WHEREAS, the following contractor(s) for the items of work listed has/have been selected as the
low bidder(s) to whom the contract(s) should be awarded:
Navarro Enterprise Construction, Inc., Omaha, NE
Specialty: $1,158,362.73
NOW THEREFORE, in consideration of the above facts, the City Council of the City of
Omaha , by this resolution, takes the following official action:
1. If for any reason the Federal Highway Administration rescinds, limits its obligations, or defers
payment of the Federal share of the cost of this project, the City hereby agrees to provide the
necessary funds to pay for all costs incurred until and in the event such Federal funds are allowed and
paid.
2. The Council hereby concurs in the selection of the above mentioned contractor(s) for the
items of work listed, to whom the contract(s) should be awarded.
3. The Council hereby authorizes the Mayor to sign the contract(s) with the above mentioned
Contractor(s)for the above mentioned work on behalf of the City.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City Council approved an Agreement with the State of Nebraska
Department of Roads (NDOR) by Council Resolution No. 573 on May 10, 2011 for Federal funding for
Omaha Concrete Repair, Pkg. 2, known as Project MAPA-5026(14), State Control No. 22499, and OPW
52100; and,
WHEREAS, in the above agreement the City of Omaha has pledged sufficient funds to
finance its share of the cost of construction of this project, and that the City of Omaha would pay costs as
set forth in the agreement; and,
WHEREAS, the State and the City received bids for the construction of this project on
November 17, 2011,at which time six bids were received for the construction of the proposed work; and,
WHEREAS, the following contractor has been selected by NDOR as the low bidder to
whom the contract should be awarded: Navarro Enterprise Construction, Omaha,Nebraska for the sum of
$1,158,362.73; and,
WHEREAS, approximately 80% of the eligible costs of this project are covered by
Federal funds with Omaha's local share of$243,256 to be paid from the 2006 Transportation Bond Fund
13182, 2010 Issue Transportation Bond Organization 117115, in accord with the approved program
agreement with NDOR for the project.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the City Council concurs with the bid award to
Navarro Enterprise Construction for Project MAPA-5026(14), State Control No. 22499, and OPW 52100,
being Omaha Concrete Repair, Pkg. 2, in the amount of$1,158,362.73, with the City's local share in the
amount of $243,256 being paid from the 2006 Transportation Bond Fund 13182, 2010 Issue

BE IT FURTER RESOLVED THAT:
