The Ordinance waives prohibitions on the sale of distilled spirits before 12:00 noon on Sunday. If adopted and approved by the State, the Ordinance would permit Ames Realty, Inc., dba "Maplewood Lanes", to sell distilled spirits on Sunday morning, February 27, 2011, beginning at 6:00 a.m., at 3030 North 101st Street in Omaha. This business is hosting a bowling tournament during this time. Although Omaha Municipal Code section 15-2 and Nebraska statutes prohibit the sale of distilled spirits in the City prior to 12:00 noon on Sunday, the statutes authorize the Liquor Control Commission to waive that restriction and allow the holder of a special designated license to sell distilled spirits prior to that hour. To accomplish this result, the Omaha Code prohibition must also be temporarily lifted. This Ordinance waives the restrictions of Section 15-2 only with respect to this specific liquor licensee on this specific day. The licensee has also applied for a special designated license for this event asking that the Commission waive the state laws controlling the sale of distilled spirits on Sunday.
