Jim Suttle,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a resolution accepting and concurring with a bid award by the State of Nebraska Department of Roads (NDOR) for Omaha Concrete Repair, Pkg. 3, known as Project OPW 52120. The City Council approved an Agreement with NDOR by Council Resolution No. 574 on May 10, 2011 for Federal Aid Project MAPA-5009(4), State Control No. 22500, which includes removal and replacement of deteriorated concrete panels on surface streets in various locations within the City of Omaha. The project also involves repair of adjacent sidewalks and drives, as well as adjustment to grade of sewer manholes, utilities and inlets within repaired panels along the project areas identified in the approved Program Agreement. NDOR received bids for this project on December 15, 2011 and is recommending award to the lowest bidder, Swain Construction, Inc., Omaha, Nebraska, in the amount of $1,110,054.58. Approximately 80% of the eligible costs of this project are covered by Federal funds leaving Omaha's local share of $233,112 to be paid from the 2006 Transportation Bond Fund 13182, 2011 Issue Transportation Bond Organization 117116, in accord with the approved program agreement with NDOR for the project. NDOR is asking the City Council to concur with this bid award by approval of the attached resolution. Swain Construction, Inc. has filed the required Annual Contract Compliance Report, Form CC-1, in the Human Rights and Relations Department. The Public Works Department requests your consideration and approval of the attached Resolution. If for any reason the Federal Highway Administration rescinds, limits its obligations, or defers payment of the Federal share of the cost of this project, the City hereby agrees to provide the necessary funds to pay for all costs incurred until and in the event such Federal funds are allowed and paid. 2. The Council hereby concurs in the selection of the above mentioned contractor(s) for the items of work listed, to whom the contract(s) should be awarded. 3. The Council hereby authorizes the Mayor to sign the contract(s) with the above mentioned Contractor(s) for the above mentioned work on behalf of the City. W O C) O O O O O O O O O O O ' O O CD 0 1-1 hH CO O O 0 O O O 0 CD CD O O CD CD O O CD O C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, the City Council approved an Agreement with the State of Nebraska Depai tnient of Roads (NDOR) by Council Resolution No. 574 on May 10, 2011 for Federal funding for Omaha Concrete Repair, Pkg. 3, known as Project MAPA-5009(4), State Control No. 22500, and OPW 52120; and, WHEREAS, in the above agreement the City of Omaha has pledged sufficient funds to finance its share of the cost of construction of this project, and that the City of Omaha would pay costs as set forth in the agreement; and, WHEREAS, the State and the City received bids for the construction of this project on December 15, 2011, at which time five bids were received for the construction of the proposed work; and, WHEREAS, the following contractor has been selected by NDOR as the low bidder to whom the contract should be awarded: Swain Construction, Inc., Omaha, Nebraska for the sum of $1,110,054.58; and, WHEREAS, approximately 80% of the eligible costs of this project are covered by Federal funds with Omaha's local share of$233,112 being paid from the 2006 Transportation Bond Fund 13182, 2011 Issue Transportation Bond Organization 117116, in accord with the approved program agreement with NDOR for the project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, as recommended by the Mayor, the City Council concurs with the bid award to Swain Construction, Inc. for Project MAPA-5009(4), State Control No. 22500, and OPW 52120, being Omaha Concrete Repair, Pkg. 3, in the amount of $1,110,054.58, with the City's local share in the amount of $233,112 being paid from the 2006 Transportation Bond Fund 13182, 2011 Issue Transportation Bond Organization 117116, in accord with the approved program agreement with NDOR for the project.
