Jim Suttle,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving Supplemental Agreement No. 2 with the State of Nebraska Department of Roads (NDOR) for the reconstruction of 156th Street from Pepperwood Drive to Corby Street, known as Federal Aid Project MAPA-5127(1), State Control No. 22376 and OPW 50677. The Program Agreement was approved by the City Council by Resolution No. 174 on February 15, 2011. The attached Agreement allows for this project to split into two phases and details Phase 2, which retains the original designations of the project and consists of all previously agreed-to improvements for the reconstruction of 156th Street from West Dodge Road to Corby Street and to upgrade Blondo Street from North 162"a Street to just east of 156th Street. Phase 1 will be designated MAPA-5127(2), State Control No. 22376A, and OPW 52288, and will be detailed through a separate Program Agreement. Federal Surface Transportation Funds are still programmed to pay the majority of the eligible costs of the new project which is currently estimated to cost $10,761,250. The city will be 100% responsible for Construction Engineering on this phase, and the total local share of this project, estimated to be $2,872,250.00 will be paid from the 2010 Transportation Bond Fund 13183, 2012 Issue Transportation Bond Organization 117117. MAPA-5127(1) CONTROL NO. 22376 156th STREET, WEST DODGE ST— CORBY ST THIS SUPPLEMENTAL AGREEMENT, made and entered into by and between the City of Omaha, Nebraska, hereinafter referred to as the Local Public Agency or"LPA", and the State of Nebraska, Department of Roads, hereinafter referred to as the "State", WITNESSETH: WHEREAS, the LPA and the State have previously entered into Program Agreement BL1159, executed by the LPA on February 17, 2011 and executed by the State on April 1, 2011, hereinafter referred to as the "Original Agreement", and a supplemental agreement executed by the LPA on July 21, 2011 and executed by the State on August 11, 2011, hereinafter referred to as "Supplemental Agreement No. 1", and WHEREAS, it now becomes necessary to split this project into two projects, and WHEREAS, the Construction Engineering phase of this project will be non-participating, and WHEREAS, it is the desire of the LPA that this project be constructed under the designation of Project No. MAPA-5127(1), Control No. 22376, as evidenced by the Resolution of the LPA dated the " day of FT.� , 2012, attached and identified as Exhibit "A" and made a part of this agreement, and NOW THEREFORE, in consideration of these facts, the LPA and State hereto agree as follows: SECTION 1. This project is being revised to split the 156t" Street project into two projects, Project No. MAPA-5127(1), Control No. 22376 and MAPA-5127(2), Control No. 22376A. The total cost of Project No. MAPA-5127(1) is currently estimated to be $10,761,250. The LPA's share of all actual eligible costs is estimated to be $2,872,250. The State agrees to use the 9 g LPA's Federal Funds for the Federal share of the actual eligible costs of the improvement which is estimated to be $7,889,000. Both the LPA and State recognize this is an estimate and the final cost may be higher or lower. SECTION 2. Preliminary engineering for Project No. MAPA-5127(2), Control No. 22376A will be provided under this project, MAPA-5127(1), Control No. 22376. SECTION 3. The costs of the Construction Engineering phase, estimated to be $900,000 will be funded solely by the LPA and will be non-participating for Federal reimbursement. WHEREAS, this reconstruction project is to be split, and therefore the previous program agreement needs to be supplemented by the attached Supplemental Agreement No. 2, which by this reference becomes a part hereof,to delineate the two phases of the original project and provide detail on Phase 2 of the project; and, WHEREAS, Phase 2 of the project, which retains the original project designations and includes all previously programmed improvements for reconstruction of 156th Street from West Dodge Road to Corby Street and Blondo Street from North 162nd Street to just east of 156th Street, with all Construction Engineering for this phase designated as non-participating for Federal Funding; and, WHEREAS, Federal Surface Transportation Funds are programmed to pay 80% of the remaining participating costs of this project, leaving the total local share, estimated to be $2,872,250.00, to be paid from the 2010 Transportation Bond Fund 13183,2012 Issue Transportation Bond Organization 117117.
