The attached Resolution initiates an application for the establishment of a neighborhood
conservation (NCE-C) district for the area generally consisting of Vinton Street from 13th Street to
24th Street. The Resolution would direct the City Planning Department to prepare an application
for the NCE-C district. That application would then be presented to the Planning Board and City
Council for approval.
Your favorable consideration is respectfully requested.

NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
THAT,pursuant to Section 39-1359 R.R.S.Neb. 2008, as amended by Legislative Bill 589 on May
24, 2011, the City of Omaha officially designates the Omaha Triathlon as a special event under LB 589 and NEB.
REV. STAT. §39-1359 R.R.S. 2008 and hereby notifies the State of Nebraska that it accepts the duties imposed by
such law,and,if a claim is made against the state,shall indemnify,defend,and hold harmless the State of Nebraska
from all claims, demands, actions,damages,and liability,including reasonable attorney's fees,that may arise as a
result of the special event and the temporary use of County Road 17 (State Street/Lake Cunningham Road) from
Wenninghoff Road to 72"d Street,72"d Street from County Road 17(State Street/Lake Cunningham Road)to State
Highway 36 and State Highway 36 from 72' Street to 138th Street between the hours of 6:00 a.m. and 12:00 p.m.,
for a part of the bicycling portion of Mimran Event Management's special event, the Omaha Triathlon.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS,Omaha Municipal Code Sections 55-601 through 51-608.1 provide for
the establishment of neighborhood conservation(NCE-C) districts; and,
WHEREAS, the area generally consisting of Vinton Street between 13th Street and
24th Street would meet the criteria for the establishment of an NCE-C district; and,
WHEREAS,the City Council wishes to initiate the application for the creation of an
NCE-C district in such area; and,
WHEREAS, ,the City Council wishes to direct the City of Omaha Planning
Department to prepare an application for the creation of the said NCE-C district.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:

THAT,an application for a neighborhood conservation(NCE-C)district for the area
generally consisting of Vinton Street from 13th Street to 24th Street is hereby initiated;and the City of
Omaha Planning Department is directed to prepare an application for the creation of such a district
pursuant to Omaha Municipal Section 55-604.
