The attached Resolution approves the contract with Valley Corporation for OPW 52209 (CSO),
being Former Economy Products Building Demolition located at 1126 North 11th Street.
The following bids were received on March 14, 2012. A detailed bid tabulation is attached.

The bids were received from E. W. Wells Group was non-compliant as defined by the Small
Emerging Business Ordinance. As well, the bid did not include required documentation
regarding asbestos abatement and lead base paint abatement disposal contractor qualifications.
The contractor has a current Contract Compliance Report Form (CC-1) on file. As is City
policy, the Human Rights and Relations Department will review the contractor to ensure
compliance with the Contract Compliance Ordinance.
The Finance Department is authorized to pay the cost of OPW 522099 (CSO) from the Sewer
Revenue Improvement Fund 21124, CSO Control Implementation Organization 116918, 2012
expenditures.
The Public Works Department recommends the acceptance of the bid from Valley Corporation
in the amount of $585,646.47, being the lowest and best bid received, and requests your
consideration and approval of this Resolution.

RE: Bids for Project OPW 52209 (CSO), being Former Economy Products Building Demolition
Dear Bidder:
Section 10-110 of the Omaha Municipal Code allows a Departmental Director to reject bids
because items on the bid received were non-compliant with the specifications. This letter is to
serve as written notice that your bid for Project OPW 52209 (CSO), Former Economy Products
Building Demolition was rejected for the following reasons:
o The bid was not compliant with the Small & Emerging Small Business requirements.
o The bid did not include required documentation regarding Asbestos Abatement and
Lead Based Paint Abatement Disposal Contractor Qualifications.
These requirements of the bid were delineated in both the Instructions to Bidders, Section 00100,
and the Bid Form, Section 00301, of the Project Manual.
Section 10-110 OMC also provides that: "Within ten (10) days after a bid is rejected, any
rejected bidder may appeal to the city council by filing with the city clerk a written objection
stating all the reasons for the objection."

Lead Based Paint Abatement Disposal Contractor Qualifications.
These requirements of the bid were delineated in both the Instructions to Bidders, Section 00100,
and the Bid Form, Section 00301, of the Project Manual.
