Jim Suttle,Mayor Public Works.Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving payment to Ramm Investment Company, LLC in the amount of$154,985.00 for a certain temporary construction easement and a.permanent sewer easement necessary for the construction of subsurface sewer structures, drainage structures and appurtenances thereto, associated with the Nicholas Street Sewer Extension-Phase I, between 16th Street and Abbott Drive, identified as City Project No. OPW 51892. The need to acquire and the authority to negotiate for these property rights was declared by Necessity Ordinance 38779, adopted on.July 20,.2010. The City of Omaha and Ramm Investment Company, LLC have reached an agreement where the City will pay the total amount of $154,985.00, $85,705.00 per the City's appraisal plus $69,280.00 as a negotiated settlement, for certain temporary and permanent easement rights for the construction of subsurface sewer structures, drainage structures and appurtenances. The basis for reaching this settlement was due to differing opinions as to the value of the real estate due to the transitional use of surrounding properties, as well as differences in opinion as to the effect of the substantial permanent sewer easements on the surface use of the property. This amount will be paid from the Sewer Revenue Improvement Fund 21124, CSO Implementation Organization 116918. The Public Works Department requests your consideration and approval of the attached Resolution. I I I _ _ C-25A CITY OF OMAHA LEGISLATIVE CHAMBER • Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, the City Council of the City of Omaha determined the necessity of acquiring various property interests for the Nicholas Street Sewer Extension-Phase I, between 16th Street and Abbott Drive, identified as City Project No. OPW 51892 by Ordinance No. 38779 which was adopted on July 20, 2010; and, WHEREAS, the City of Omaha Public Works Department has been in negotiations with various property owners including Ramm Investment cCompany, LLC; and, WHEREAS, The City of Omaha and Ramm Investment Company, LLC have come to an agreement of$85,705.00 as just compensation, plus $69,280.00 as a negotiated settlement, for a total amount of $154,985.00 for certain temporary and permanent easement rights for the construction of subsurface sewer structures, drainage structures and appurtenances thereto, associated with the Nicholas Street Sewer Extension-Phase I, between 16th Street and Abbott Drive, identified as City Project No. OPW 51892; and WHEREAS, the total amount of $154,985.00 will be paid from Sewer Revenue Improvement Fund 21124, CSO Implementation Organization 116918; Sewer Revenue Bonds will be issued to finance this project. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: THAT, the City of Omaha and Ramm Investment Company, LLC have come to an agreement for the total consideration of $154,985.00 for certain temporary and permanent easement rights, being necessary for the construction of subsurface sewer structures, drainage structures and appurtenances thereto, associated with the Nicholas Street Sewer Extension-Phase I, between 16th Street and Abbott Drive, identified as City Project No. OPW 51892, is hereby approved. BE IT FURTHER RESOLVED: THAT, the Finance Department is authorized to pay the total amount of $154,985.00, $85,705.00 as originally determined to be just compensation in addition to a negotiated settlement in the amount of $69,280.00, from the Sewer Revenue Improvement Fund 21124, CSO Implementation Organization 116918, Sewer Revenue Bonds.
