The attached Resolution is prepared at the request of the Law Department.
The Resolution continues the cable television franchise held by CenturyLink, Inc. (formerly Qwest
Broadband) in effect until formal and informal franchise renewal negotiations and determinations are
completed. The franchise expired on September 3, 2011, and has been extended through April 30,
2012. The City is actively working with all its cable television franchisees to reach agreement on the
terms of renewing their contracts, but the efforts on the CenturyLink franchise cannot be completed
before the expiration date. Significant steps in the process are expected to be completed before the end
of 2012. Discussions with CenturyLink are not as far along as the discussions with Cox •
Communications and this Resolution only addresses the CenturyLink franchise.
If agreement cannot be reached,the City reserves the right to exercise all its rights under federal law.

All of RDG's comprehensive plans include extensive park and recreation sections. In addition to this work,
Ms.Haase has managed the development of Park Master Plans in Papillion and Bellevue,Nebraska,including
implementation and financing tools.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City of Omaha has awarded CenturyLink, Inc., ("CenturyLink") a
franchise to operate a cable communications system within the City and that company currently
operates that system within the City; and,
WHEREAS, by its provisions, the franchise granted CenturyLink expired on
September 3, 2011, and CenturyLink has asked for its renewal; and,
WHEREAS, in accordance with the Cable Communications Policy Act of 1984, 47
U.S.C. § 546, the City and CenturyLink have commenced informal proceedings to consider
renewal of the franchise and, by mutual agreement, the term of the franchise was extended
through April 20, 2012; and,
WHEREAS, these informal proceedings are expected to continue past the
extended date and CenturyLink has requested further extension of the franchise term; and,
WHEREAS, the City wishes to allow operation of the CenturyLink cable
communication system to continue under the current franchise agreement until completion of the
informal negotiations and any formal renewal proceedings that may be commenced in the future
with CenturyLink.
NOW,THEREFORE,BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, the term of the franchise held by CenturyLink, Inc., to operate a cable
communications system within the City of Omaha is hereby continued to December 31, 2012.
This continuance is subject to compliance with the law and the terms, conditions, and obligations
of that franchise agreement and this resolution.
