Transmitted herewith is a Resolution to approve the attached Declaration of Use, which will
formally dedicate the portions of Lot 2, Eagle Run West Replat 4,for sidewalk purposes.
The City is presently reconstructing 144th Street from Franklin Street to Eagle Run Drive and
Blondo Street from 135th Street to Eldorado Drive. This project is known as Federal Aid Project
MAPA-5001(19), State Control No. 22202A, SP 2000-14A and 2012-2017 Capital Improvements
Program— Transportation Project 105. As a condition of funding for the project, the State of
Nebraska and the Federal Highway Administration have required that the City formally dedicate
certain portions of Lot 2, Eagle Run West Replat 4, for sidewalk purposes.
The attached Declaration of Use accomplishes this formal dedication. The approval of this
Declaration of Use and the Resolution will not substantially affect any of the existing uses in the
area and does not require an allocation of additional funding.

DECLARATION OF USE
This Declaration of Use, made on the undersigned date by the City of Omaha, Nebraska
("City"), affects the Dedicated Area described below.
WHEREAS, the City owns the real estate generally known as 2909 No. 144th Street,
which is legally described as follows:
Lot 2, Eagle Run West Replat 4, a subdivision, as surveyed, platted and recorded in
Douglas County, Nebraska.
WHEREAS, the City wishes to formally declare and dedicate for permanent sidewalk
purposes, a portion of Lot 2, Eagle Run West Replat 4, such portion is cross-hatched and
identified as tract 11 and depicted on the attached Exhibit A , (hereinafter referred to as "the
Dedicated Area").
KNOW ALL MEN BY THESE PRESENTS:
The City hereby declares and dedicates the Dedicated Area for public sidewalk purposes,
and appurtenances thereto.

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, as recommended by the Mayor, the attached Declaration of Use,
dedicating certain portions of Lot 2, Eagle Run West Replat 4 for sidewalk purposes be and
hereby is approved, and the City Council hereby authorizes the Mayor and City Clerk to sign the
attached Agreement on behalf of the City of Omaha.
