This project has subsequently been split into two phases which are programmed as Transportation Projects 410 and 411 in the 2012-2017 Capital Improvement Program. The City Council approved a Preliminary Engineering Services Agreement for this project by Council Resolution No. 233 on February 27, 2007; since that time, additional services have been determined as necessary for completion of this project, as detailed in the attached Supplemental Agreement. Alfred Benesch & Company Inc. has agreed to perform the necessary supplemental services for an additional fee of$114,880.61, with 80% of the contract cost being paid by Federal funds and the City's 20% local share, in the amount of $22,976.12, will be paid from the 2006 Transportation Bond Fund 13182, 2008 Issue Transportation Bond Organization 117113. Alfred Benesch and Company has filed the required Annual Contract Compliance Form CC-1, in the Human Rights and Relations Department. STPC-3811(1) CONTROL NO. 22209 168TH ST, WEST CENTER— Q ST THIS SUPPLEMENTAL AGREEMENT, made and entered into by and between the City of Omaha, Nebraska, hereinafter referred to as the Local Public Agency or"LPA," and Alfred Benesch & Company, hereinafter referred to as the "Consultant." WHEREAS, the Consultant and the LPA entered into Engineering Agreement XK0707 executed by the Consultant on January 16, 2007 and executed by the LPA on March 2, 2007, hereinafter referred to as the "Original Agreement", providing for preliminary engineering and environmental documentation services for Project No. STPC-3811(1), and WHEREAS, it is necessary that work not contemplated in the Original Agreement, be added under this supplemental agreement, and WHEREAS, it is necessary to increase the Consultant's compensation by this supplemental agreement for the additional work necessary to complete the project, and WHEREAS, it is the desire of the LPA that the project be constructed under the designation of Project No. STPC-3811(1), as evidenced by the Resolution of the LPA dated the 3,/sr" day of --r , 2012, attached and identified as EXHIBIT "A" and made a part of this agreement, and NOW THEREFORE, in consideration of these facts, the Consultant and LPA agree as follows: SECTION 1. A written Notice-to-Proceed was issued to the Consultant on November 30, 2010 to perform the additional work through Consultant Work Order No. 1, which is attached as Exhibit "C" and hereby made a part of this supplement agreement. Any additional work or services performed by Consultant on the project prior to the date specified in the written Notice-to-Proceed is not eligible for reimbursement. SECTION 2. The LPA will issue the Consultant a written Notice-to-Proceed upon full execution of this agreement for the additional services outlined in the Scope of Services, which is attached as Exhibit "B" and hereby made a part of this supplemental agreement. Any additional work or services performed by Consultant on the project prior to the date specified in the written Notice- to-Proceed is not eligible for reimbursement. SECTION 3. For the work required under both Consultant Work.Order No.1 and the Scope of Services, Section V of the Original Agreement is hereby amended and the fixed-fee-for-profit is increased from $11,961.41 to $23,134.33, an increase of$11,172.92. LPA will not make payments directly to Consultant for services performed under this agreement. Instead, the State will serve as a paying agent for LPA, and will pay Consultant directly for properly submitted and approved invoices using both LPA and Federal funds based on the applicable project federal cost participation percentage. SECTION 5. The LPA and Consultant agree that, except as specifically amended by this supplemental agreement, all terms and conditions of the Original Agreement on Project No. STPC-3811(1), executed by the Consultant on January 16, 2007 and executed by the LPA on March 2, 2007 shall remain in full force and effect. In February 2007, the City of Omaha (City) and HWS Consulting Group, Inc., now Alfred Benesch & Company (Consultant), entered into an agreement to complete an Environmental Assessment (EA) in compliance with the National Environmental Policy Act of 1969 (NEPA) for the Project. Following a kickoff meeting in March 2007, and a Public/Agency Scoping Meeting in May 2007, the Project was placed on hold in 2008 due to concerns by the Federal Highway Administration (FHWA) about the logical termini of the Project. In April 2010, these concerns were resolved, and the Project was re-initiated. The following additional tasks address revisions to the original Scope of Services that the Consultant agrees to provide for the Project based on the modification of the schedule, additional requirements of the NDOR Local Public Agency (LPA) Manual, and other policy changes. In November 2010, a Consultant Work Order (CWO) was approved, contingent on the approval of this Supplement, that authorized the Consultant to begin work on several additional tasks, which are also described in this Supplement. DESCRIPTION OF LOGICAL TERMINI: In a memorandum dated April 27, 2010,NDOR and FHWA agreed on the logical termini for the Project to include the area between Pacific Street and Q Street. The following is the description of logical termini for the Project(which will be included in the EA): "The City of Omaha programmed two separate projects: STPC-3811(2) (CN: 22210) 168th Street, from West Center to Poppleton and STPC-3811(1) (CN: 22209) 168th Street, from West Center Road to Q Street. In May 2006 the City of Omaha was instructed by FHWA to combine both projects on 168th Street into one environmental document. 168th Street is currently a two lane roadway for the majority of the length between Q Street and Pacific Street. Widening to the ultimate four lane divided roadway typical section has been completed along 168th St from V to P Streets (this is in the Q Street area), from Oak Drive to Gold Street (W. Center Road area) , and from Poppleton Ave to West Dodge Street (Pacific Street area). There are no plans to improve these segments as part of the current projects. The proposed 168th Street projects (CN: 22209 and 22210) would complete the construction of the four lane divided typical section and provide auxiliary lanes as necessary to maintain traffic to an acceptable level of service. The estimated average daily traffic on this section of 168th Street is currently 16,000 vpd. The MAPA projected design year volume is 32,000 vpd. MAPA currently has this segment of 168th Street to be developed as a four lane divided arterial in the 2035 LRTP. According to the NDOR April 27, 2010 Memorandum, the City of Omaha has no current improvement plans north or south of the aforementioned logical termini for. the 168th Street project. The intersections with 168th Street at Q and Pacific Streets are fully developed to their ultimate section and no further improvements would be done at either intersection." The City will provide all relevant studies, reports, mapping, and data at no cost to the Consultant. The Consultant shall return such material at the conclusion of the Study. The City will also provide meeting facilities as warranted. More specifically: • The City will provide public and committee meeting rooms and attendant equipment. • The City will provide available traffic statistics, relevant studies, and public information services. • The City will provide preliminary conceptual design plans and required information in support of the development of the EA document and subsequent meetings. • The City will review interim reports and provide comments to the Consultant regarding content and process. • Cost estimates, quantity estimates, and capital cost estimates for up to two candidate build alternatives will be prepared by the City and provided to the Consultant for inclusion in the EA document. LIMITATIONS TO CONSULTANT'S WORK SCOPE: The City will handle information disseminated to media, civic groups, and elected officials if required in addition to the items listed in the scope of work. The Consultant will provide handouts and visual illustrations as necessary to be used for these meetings. As with Subtask 5.1, the Consultant will require additional review of roadway and bridge layouts to verify the original fieldwork was adequate for the current proposed project and to prepare the final geotechnical engineering report including the following data and recommendations: Data: 1. Boring logs. 2. Density and moisture content of undisturbed soil samples. 3. Unconfined compressive strengths of selected samples of foundation soils. 4. Geology: a) Depth to groundwater--if encountered. b) Summary of surface and subsurface conditions at the site. 5. Soil classification chart and tables listing the criteria used to describe various soil properties. Recommendations: 1. Allowable soil bearing pressure for retaining wall structures. 2. Minimum depth to suitable bearing material. 3. Analysis of soil to ascertain presence of potentially expansive soils. 4. Recommendations for site preparation prior to fill placement, wall construction and pavement construction. 5. Recommended types of fill and backfill materials and compaction requirements. 6. Active, passive, and at-rest earth pressures for use in design of retaining walls. 7. Recommendations for drainage of retaining walls. 8. Recommendations for bridge foundation design. Additional scope is required to account for re-engagement of Consultant's geotechnical staff for evaluation of a new bridge design and incorporation into the Geotechnical report. This task is limited to one revision of the Purpose and Need based on the requirements of the NDOR LPA Manual by both NDOR and FHWA and then to compile the comments and complete the document at a meeting in Lincoln with the Consultant,NDOR/FHWA and the City in attendance. Additional scope is required to incorporate the City's traffic data and analysis into a revised draft, attend one meeting with NDOR/FHWA to discuss any potential needed revisions to the draft, and make the necessary revisions. Subtask 6.4 - Section 4(f) Evaluation: Because this project crosses designated park and recreational areas, FHWA will require a Section 4(f) evaluation. Under Section 4(f) of the Department of Transportation Act, FHWA requires preparation of a Section 4(f) Evaluation to address potential impacts to Section 4(f) properties/lands (i.e. public parkland, wildlife refuges or sites on or eligible for the National Register of Historic Places). A Draft and Final Section 4(f) Evaluation will be developed in coordination with FHWA. While this task was similarly described in the original Scope of Services under Subtask 6.4 (and also portions of Subtasks 7.1 and 7.2), it was listed as "OPTIONAL" and not anticipated to be required. Additional scope is required to complete a Section 4(f) Evaluation. Subtask 6.5—Section 6(f) of the Land and Water Conservation Funds Act: Section 6 (f) (3) of the Land and Water Conservation Funds Act (LWCF) requires the National Park Service (NPS) to ensure that Federal investments in LWCF assistance are being maintained in public outdoor recreation use. If LWCF funds have been committed to public outdoor recreation use, information (proposed project and required compensation as required under Section 6(f) (3) adequate to determine whether to approve a project sponsor's request to convert an assisted site or facility to other than public outdoor recreation uses) must be provided to the Department of the Interior for approval. NDOR has requested that a letter be submitted to the Nebraska Game and Parks Commission (NGPC) in coordination regarding Section 6(f) properties. In its comments, NGPC will inform the City or confirm whether the park has been wholly or partially developed with LWCF grant monies. The Consultant will submit a letter to the City for subsequent submittal to NDOR. This task does not include coordination with NGPC or NPS to resolve any proposed conversion. While this task was similarly described in the original Scope of Services under Subtask 6.5, it was listed as "OPTIONAL" and not anticipated to be required. Additional scope is required to comply with the NDOR request. • Subtask 6.6—Noise Analysis: The Consultant will complete a traffic noise study for the Project to determine if the increased capacity of 168th Street and subsequent traffic volume increase will create potential traffic-related noise impacts. According to FHWA, a FONSI is issued when environmental analysis and interagency review during the EA process find a project to have no significant impacts on the quality of the environment. The FONSI document is the EA modified to reflect all applicable comments and responses. If it was not done in the EA, the FONSI must include the project sponsor's recommendation or selected alternative. No formal public circulation of the FONSI is required, but the state clearinghouse must be notified of the availability of the FONSI. In addition, FHWA recommends that the public be notified through notices in local newspapers. A sample of the language used for a FONSI can be found in the FHWA Technical Advisory T6640.8A. This task was not included in the original Scope of Services.
