The Resolution will approve the attached City of Omaha Public Works Department Towing Rules for Snow Emergencies and Construction Zones. Omaha Municipal Code Section 36-238 authorizes the Public Works director to move any parked vehicle violating the City's snow emergency or. construction zone rules, to an available nearby location. That section adds that the department shall adopt rules for such purpose, and that the City Council shall approve the rules by resolution. The proposed rules are attached to this resolution. These rules are adopted by the Public Works Department and approved by City Council Resolution,pursuant to Omaha Municipal Code Section 36-238. 2. The Public Works Department may tow a motor vehicle parked in violation of any portion of Omaha Municipal Code Sections 36-177 through 36-180 (Snow Emergency and Construction Zone Rules), if the motor vehicle is directly interfering with operations or activities under the section violated. 3. In such case, the motor vehicle may be towed to an available nearby location. The owner of the vehicle is responsible for locating the vehicle after it has been moved. 4. The decision to tow shall be made by the Public Works director or his/her designee. The "available nearby location" to which the vehicle is to be towed shall be determined by the Public Works Department's foreman. 5. Immediately after towing under these rules, the Public Works Department shall affix a notice to the windshield or other appropriate place on the motor vehicle, stating "This vehicle was parked in violation of Omaha Municipal Code Sections 36-177 through 36- 180. It was moved to this location by Order of the City of Omaha Public Works director.", or similar language. 6. The City's remedies provided under these rules are in addition to any civil or criminal remedies or actions available under local or state law. 7. Any person aggrieved by the towing of.a motor vehicle under these rules may file a written objection or protest with the Public Works director within 10 days of the towing. The Public Works director shall hold a hearing, at which all parties may present evidence regarding the towing.
