Transmitted herewith is a Resolution establishing a special billing rate for sewer service for Scott
Residence Hall, located at 6510 Pine Street.
The application of sewer service rates as specified in Section 31-145 through 3 1-147 of the Omaha
Municipal Code for Scott Residence Hall, located at 6510 Pine Street, is determined to be
inequitable and unfair to such user and that such user shall be subject to special rates as provided in
Section 31-148 of the Omaha Municipal Code. This determination has been made based on the
evidence of water loss, due to irrigation and evaporation, demonstrated by the MUD metering
system present at the location. The provisions of how the adapted rates are to be determined and
documented are set forth in the attached Resolution.
The Public Works Department requests your consideration and approval of the attached
Resolution and Interlocal Agreement.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Section 31-148 of the Omaha Municipal Code provides for the
establishment of special rates for sewer service users wherein the rates specified in Section 31-145
through 31-147 are inequitable or unfair either to the City or the user; and,
WHEREAS, the Quality Control Division of the Public Works Department has
reviewed information submitted by one such user of the sewerage system and determined that the
application of the rates specified in Section 31-145 through 31-147 are inequitable and unfair to
such user; and,
WHEREAS, the Quality Control Division recommends that the subject user be
charged sewer service use rates based on the amount of flow entering the sewerage system as
determined from metered water usage less that amount which can be exempted from such charges,
in accordance with Section 31-148; and,
WHEREAS, the sewer service user to be affected by this action is known as the
Scott Residence Hall, located at 6510 Pine Street(MUD account#291675-1248489); and,
WHEREAS, that part of the submetered water usage which is fed to the cooling
tower, and not lost to evaporation, is submetered and returned to the sewer system; and,
WHEREAS, the change proposed herein has been recommended by the Finance
Director and approved by the Mayor in accordance with Section 31-148 of the Omaha Municipal
Code; and
WHEREAS, it is proposed that sewer service be billed to the said user under the
following terms and conditions:
1. The application of sewer service rates as specified in Section 31-145 through 31-
147 of the Omaha Municipal Code for Scott Residence Hall is determined to be inequitable and
unfair to such user and that such user shall be subject to special rates as provided in Section 31-148
of the Omaha Municipal Code.
2. The sewer service rate for the Scott Residence Hall, for the facility located at
6510 Pine Street (MUD account#291675-1248489) shall be subject to the prevailing monthly hand
billing charge and the prevailing customer, flow, abnormal, and other applicable charges under
Section 31-147; the quantity of wastewater discharged shall be determined as follows:
The quantity of water actually discharged to the sewerage system shall be billed on
the basis of the cooling tower blow-down water usage recorded on the cooling tower
return submeter. All other water metered via the MUD main meter which feeds the
cooling tower is lost to either irrigation or evaporation, and is not returned to the
sewer system.

3. The Environmental Quality Control Division of the Public Works Department is
authorized to prepare billing and credit calculations and statement documents with MUD for the
above user each month from information to be provided to the Quality Control Division by this user
and subject to at least annual audits of meter readings, or at such a frequency as is deemed
necessary by the Quality Control Division.
4. The application of these special rates, as recommended, is allowed this user,
provided that it furnish to the Quality Control Division such meter readings and other pertinent
information, as may be required, no later than the tenth(10th) day of each month. Failure to supply
the required information will result in the application of the rates specified in Sections 31-145
through 31-147 of the Omaha Municipal Code, for this user.
5. In the event that any of the meters required to document the evaporative losses
become inoperable, the Quality Control Division shall suspend granting a water loss allowance for
sewer use fees until such time as all water meters return to correct functioning service.
6. In the event that the tower experiences a stuck level-control float or other such
malfunction which causes unmetered water to discharge into the sewer system, the Quality Control
Division may suspend granting a water loss allowance for sewer use fees until such time as the
system returns to correct functioning service.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF OMAHA:
THAT, as recommended by the Mayor, pursuant to Omaha Municipal Code section
31-148, a special billing rate for sewer service provided to Scott Residence Hall, located at 6510
Pine Street (MUD account #291675-1248489), shall be established in accordance with the terms
and conditions stated herein.
