The attached Resolution approves the contract with Jackson's Complete Concrete for OPW 5?421, being
New Sidewalk Construction and Sidewalk Repair at Various Locations in the Southwest Quadrant of the
City of Omaha (from 72"a Street to the Omaha City Limits on the West between the South Side of Dodge
Street to the Omaha City Limits on the South).
The following bids were received on February 27, 2013. A detailed bid tabulation is attached.

The bids received from DIY Holding Company and One Solution, LLC were aon-compliant as defined by
the Responsible Contractor Ordinance.
The contractor has a current Contract Compliance Report 1-orm (CC-1) on file. As is City policy, the
Human Rights and Relations Department will review the contractor to ensure compliance with the
Contract Compliance Ordinance.
The Finance Department is authorized to pay the cost of OPW 5242 I from the 2010 Transportation Bond
Fund 13183, Transportation Bond Organization 117117 in the amount of$26,343.75 and from the Capital
Special Assessment Fund 13573, Special Assessment Organization 116168 in the amount of$26,343.75,
year 2013 expenditures.
The Public Works Department recommends the acceptance of the nid from Jackson's Complete Concrete
in the amount of$52,687.50, being the lowest and best bid received, and requests your consideration and
approval of this Resolution.

RE: Bids for Project OPW 52421
Dear Bidder:
Section 10-110 of the Omaha Municipal Code allows a Departmental Director to reject bids
because items on the bid received were non-compliant with the specifications. This letter is to
serve as written notice that your bid for Project OPW 52421, being the "2013 New Sidewalk
Construction and Sidewalk Repair at Various Locations in the Southwest Quadrant of the City of
Omaha" project was not compliant with the Responsible Contractor Ordinance requirements and
has therefore been rejected.
OMC 10-108(a) states: "In addition to any other requirements contained in Section 5.17 of the
Home Rule Charter of the City of Omaha, 1956, or any other ordinances contained herein, all
bidders seeking to contract with the city bid must complete a responsible contractor form and
submit it with bid documents at the time of the bid opening. Failure to submit the responsible
contractor form at the time of the bid opening will result in the bid being rejected." In the review
of your bid, it was determined that the required RC-1 form was not included with the bid
documents at the time of bid opening.
Section 10-110 also provides that: "Within ten (10) days after a bid is rejected, any rejected
bidder may appeal to the city council by filing with the city clerk a written objection stating all
the reasons for the objection."

WHEREAS, Jackson's Complete Concrete submitted a bid of $52,687.50, being the

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the contract with Jackson's Complete Concrete
for OPW 52421, being New Sidewalk Construction and Sidewalk Repair at Various Locations in
the Southwest Quadrant of the City of Omaha (from 72" Street to the Omaha City Limits on the
