Transmitted herewith is a Resolution approving an Interlocal Areement between the City of
Ralston and the City of Omaha for improvements to areas of 84t Street between Q Street and
Harrison Street within the jurisdiction of the City of Ralston, as a part of the planned resurfacing
of south 84th Street, known as OPW 52488.
This Agreement provides for the definition of responsibilities and the terms and conditions under
which these improvements are to be constructed. Under the terms of this agreement, the Public
Works Department will undertake specified street paving improvements, improvements to bring
curb ramps into compliance with the American with Disabilities Act specifications and storm
sewerage improvements. The Agreement further provides for the manner in which the City of
Ralston will share in the costs of the project, with Ralston's contribution for the portion of work
under their jurisdiction currently estimated at $214,477.50.
The Public Works Department requests your consideration and approval of the attached
Resolution and Interlocal Agreement.

AGREEMENT

FISCAL YEAR 2014 RESURFACING PROJECT
84TH STREET FROM Q STREET TO HARRISON STREET
THIS AGREEMENT made and entered into by and between the City of Ralston,hereinafter referred to
as"Ralston",and the City of Omaha,hereinafter referred to as"Omaha",
WITNESSETH:
WHEREAS,it is the desire of Ralston and Omaha to maintain the urban extension of 84th Street in a
favorable condition for the general public. Because of increased traffic and general deterioration of the
roadway,84th Street requires resurfacing work. It is hereby agreed that Ralston and Omaha join in items
relating to the resurfacing work on 84th Street,and
WHEREAS;related items of work to the resurfacing project shall consist of: constructing ADA curb
ramps,removal and replacement of curb and gutter,removal and replacement of storm sewer inlet tops,and
storm sewer pipe removal and replacement.
NOW THEREFORE,in consideration of these facts,the parties hereto agree as follows:
SECTION 1:Omaha agrees to prepare specifications,take bids,award contracts,provide the necessary
inspection to insure the performance is within specification requirements and maintain sufficient records to fully
document locations and actual costs of work performed. Omaha also agrees that Ralston's share of the cost of
the work shall be limited only to the actual construction cost of accepted work.
SECTION 2:The specific locations of work which is authorized,within Ralston's financial obligations to
Omaha are as follows:
• All additional work referenced above along 84th Street from Q Street to Harrison Street except the
South bound lane of 84th Street from Q Street to the North end of railroad viaduct which is within
Omaha's jurisdiction.
SECTION 3:Ralston agrees to make payment to Omaha for its share of the actual construction costs on or
around October 1st,2013 and the subsequent receipt of the Omaha's invoice.
SECTION 4:Omaha shall maintain all books,documents,papers,accounting records and other evidence
pertaining to costs incurred and shall make such material available at its office at all reasonable times during
the contract period and for three(3)years from the date of final payment under this agreement;and copies
thereof shall be furnished by the City if requested.
SECTION 5:Nothing said or implied to the contrary,Ralston's share based on estimated costs under this
agreement is$214.477.50,more or less based on actual construction costs to be determined at completion and
acceptance of project.
IN WITNESS WHEREOF,the parties hereto have caused these presents to be executed by their
proper officials thereunto duly authorized as of the dates below indicated.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, the City of Omaha and the City of Ralston, Nebraska desire to enter into an
agreement for the construction of improvements to South 84th Street between Q Street and
Harrison Street, which is identified as Project OPW 52488; and,
WHEREAS, according to the attached Interlocal Agreement, which by this reference
becomes a part hereof, the City of Omaha Public Works Department will provide specified street
paving improvements, improvements to bring curb ramps into compliance with the American
with Disabilities Act specifications and storm sewerage; and,
WHEREAS, as detailed within the Agreement, the City of Ralston will reimburse the
City of Omaha for the portion of work to be conducted on South 84th Street within its
jurisdiction, providing an currently estimated contribution of $214,477.50 toward the project,
with the final amount to be determined based on actual construction costs.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
THAT, as recommended by the Mayor, the Interlocal Agreement between the City of
Omaha and the City of Ralston construction of improvements to South 84th Street between Q
Street and Harrison Street, which is identified as Project OPW 52488, is hereby approved.
BE IT FURTHER RESOLVED:
THAT, the Finance Department is authorized to receive a contribution to the project from the
City of Ralston currently estimated to be $214,477.50, with the final amount to be determined
based on actual construction costs.
