The attached Resolution approves the Subdivision Agreement between Elk Ridge Independent
Living, LLC, a Nebraska Limited Liability Company, and the City of Omaha. This Subdivision
Agreement covers the public improvement of Elk Ridge Replat 6 (Lots 1-4), a subdivision
located southeast of 194th Circle and Seward Street.
The Agreement provides for Interceptor Sewer Fees in the amount of $64,350 and Watershed
Management Fees in the amount of$33,254.10 to be paid as building permits are issued.
The Agreement provides for Park Fees as follows: Trail & Boulevard Fee, to be assessed as
building permits are issued; and Community Parks Fee, approximately half of which, $2,200.95,
is to be paid by the District at the time of final platting and which may be paid by General
Obligation, and the remaining half to be paid as building permits are issued.
The Public Works Department requests your consideration and approval of the attached
Resolution and Subdivision Agreement.

SUBDIVISION AGREEMENT
ELK RIDGE REPLeAT 6
This Subdivision Agreement, made this , ' day of , 20/3 by
and between ELK RIDGE INDEPENDENT LIVING, LLC , Nebr ka Limited Liability
Company (hereinafter referred to as "SUBDIVIDER"), and the CITY OMAHA (hereinafter
referred to as "CITY").
WHEREAS, the Subdivider is the owner of the land shown on the proposed plat attached
hereto as Exhibit"A"(hereinafter referred to as"PROPERTY"), and,
WHEREAS, the Subdivider proposes to build public and private improvements on the
property; and,
WHEREAS, the Subdivider wishes to connect the system of sanitary sewers to be
constructed within the property to the sewer system of the City of Omaha; and,
WHEREAS, the Subdivider and City desire to agree on the method for the installation
and allocation of expenses for public improvements to be constructed in the property.
NOW, THEREFORE, in consideration of the above the following is agreed between the
parties hereto:
1. Right to connect to City sewer system. The City hereby acknowledges that it has given the
Subdivider the right to connect the sanitary sewer system of the property to the City sanitary
sewer system, subject to obtaining proper permits and paying the regular fees.
2. Interceptor Sewer Fee. The owner of each lot shall make payment to the City of Omaha for
the construction of interceptor sewers. This fee is computed as follows for the lots shown on
the plat(Exhibit "A"). Lot 1, Elk Ridge Replat 6 as shown herein in Exhibit"A" shall not be
subject to the Interceptor Sewer fee, as it already has existing buildings with existing
connections to the City's sewer system. However, the parties acknowledge that in the event
of any future subdivision of Lot 1, Elk Ridge Replat 6 into multiple buildable lots, any
newly-created lots shall be subject to the then-current Interceptor Sewer fee through the
amendment of this agreement by the parties, while the lot containing the existing buildings
will continue not to be subject to the fee. Payment shall be made to the City Permits and
Inspections Division prior to receiving a building permit to construct improvements on any
lot. The total number of multifamily residential units anticipated for future construction is
based upon the City of Omaha approved layout attached as Exhibit "B". Payment shall be
based on the current fee adopted by the Omaha City Council and is currently as follows:
Lots 2-4, Multi Family Residential,
75 Units @ $858.00 $64,350.00

3. Watershed Management Fee. The owner of each lot shall make payment to the City of
Omaha for Watershed Management Fees. This fee is computed as follows for the lots shown
on the plat (Exhibit "A"). Payment shall be made to the City Permits and Inspections
Division prior to receiving a building permit to construct improvements on any lot. Payment
shall be based on the current fee adopted by the Omaha City Council and is currently as
follows:
Lots 1-4, Multi Family Residential,
10.077 Acres @ $3,300.00 $33,254.10
TOTAL $33,254.10
4. Park Fees. The owner of each lot shall make payment to the City of Omaha for Park Fees.
Lot 1, Elk Ridge Replat 6 shall not be subject to the Park fee, as it is already an improved lot.
However, the parties acknowledge that in the event of any future subdivision of Lot 1, Elk Ridge
Replat 6 into multiple buildable lots, any newly-created lots shall be subject to the then-current
park fee through the amendment of this agreement by the parties, while the lot containing the
existing buildings will continue not to be subject to the fee.
Trails / Boulevard Fee. There will be no platting fees for trails and boulevards. A Trail and
Boulevard Fee will be assessed at the time of building permit.
Community Parks. Approximately fifty percent (50%)of the Community Park(CP) Fee will be
paid by the Subdivider at the time of final platting. This portion of the CP Fee is calculated on a
per-acre basis as follows:
Lots 2-4, Residential,
4.891 Acres @ $450.00 $2,200.95
TOTAL: $2,200.95
The remaining portion of the Community Park Fee will be assessed at the time of building
permits on a per-lot basis.
5. Binding effect. The Subdivision Agreement shall be binding upon the parties, their
respective successors, and assigns.

RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA:
WHEREAS, Elk Ridge Independent Living, LLC, a Nebraska Limited Liability Company,
proposes to build a subdivision to be known as Elk Ridge Replat 6(Lots 1-4)which will be located southeast
of 194th Circle and Seward Street; and,
WHEREAS, Elk Ridge Independent Living, LLC, a Nebraska Limited Liability Company,
will build public and private improvements in this subdivision; and,
