Jean Stothert,Mayor Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a Resolution approving a Memorandum of Understanding (MOU) with the Blackstone Business Improvement District Board (BID) regarding a proposed roadway project converting a section of Farnam Street located within the bounds of the Blackstone BID from a one-way street to a two-way street. According to the MOU, the Blackstone BID will reimburse the City $120,000.00 towards the conversion project costs, currently estimated at $302,000.00, for the segment of Farnam Street between 35t' Street and 421-Id Street. The remaining costs are projected to he covered by City and Community Development Block Grant funds. This project will be undertaken subject to availability of funds and ability to meet design standards protecting the health, safety, and general welfare of the public, as outlined within the terms of the MOU. The Public Works Department requests your consideration and approval of the attached Resolution and Memorandum of Understanding. Respectfully submitted. Curtiss D to Fina ce Director Rrn\ tiArplq 1790htp C-25A CITY OF OMAHA LEGISLATIVE CHAMBER Omaha,Nebraska RESOLVED BY THE CITY COUNCIL OF THE CITY OF OMAHA: WHEREAS, the City of Omaha desires to enter into agreement with the Blackstone Business Improvement District Board regarding a road project involving Farnam Street between 36th Street and 42nd Street; and, WHEREAS, the attached Memorandum of Understanding, which by this reference becomes a part hereof, defines the responsibilities of the City of Omaha and of the Blackstone Business Improvement District Board in regard to the conversion of this section of Farnam Street from a one-way street to a two-way street; and, WHEREAS, the City of Omaha will receive a cost share from the Blackstone Business Improvement District in the amount of$120,000.00, with the remaining cost of the project to be covered by City and Grant funds, recognizing that the undertaking of this project is contingent on availability of funding and acceptable design standards, according to the details of the Memorandum of Understanding. Y Councilmember Adopted J 14 7 2014 1-6 7i4,-- --- ity rk //7 Approve Mayor MEMORANDUM OF UNDERSTANDING This Memorandum of Understanding is entered into on the date of execution shown below, by and between the City of Omaha ("City") and the Blackstone Business Improvement District Board("the BID"). WHEREAS, the BID is a business improvement district board created by resolution of the Omaha City Council on October 23, 2012; and WHEREAS, the BID's business area consists of the lots abutting Farnam Street from 36th to 42nd Streets; and, WHEREAS, the BID desires that the City convert Farnam Street from 36th to 42nd Streets from a one-way street to a two-way street; and, WHEREAS, the BID wishes to raise funds and contribute such amounts to the City so that the City can carry out such a conversion of Farnam Street; and WHEREAS, the BID understands and acknowledges that on-street parking may be reduced pursuant to such conversion of Farnam Street. The parties therefore agree as follows: 1. The total project cost for the Farnam Street conversion is currently estimated by the City to be approximately $302,000. 2. The BID will raise funds and contributions to be used toward the conversion of Farnam Street from a one-way street to a two-way street, between 36th and 42nd Streets. The BID shall contribute collected funds to the City, until a total amount equaling $120,000 has been contributed to the City for such purpose. 3. It is currently expected that funding for the conversion project may be provided from the following additional sources: a. $100,000 from the City Public Works Department b. $100,000 from the City's Community Development Block Grant Fund. 4. Upon receipt of the said $120,000 in contributions from the BID and the securing of other funds as listed in section 3 above, in a total amount equaling the current estimated project cost, the City intends to execute a conversion of Farnam Street, from a one-way street to a two-way street, from 36th to 42nd Streets. 5. The performance of the conversion project by the City is subject to the availability of funding and the protection of the health, safety, and general welfare of the public. 6. Work to be performed by the City in such conversion is expected to include re- striping, signage changes, traffic light changes, and other associated improvements necessary to carry out the conversion. It is estimated that construction can commence in the spring of 2014, if there are no delays caused by funding difficulties or other causes. The design and execution of the conversion project shall be determined by the City, in its sole discretion. 7. This Memorandum of Understanding may be terminated by either party upon written notice to the other party at least seven (7) days prior to the effective date of the termination. 8.
