This Amendment to the Subdivision Agreement covers the public improvement of West Village Pointe Replat 8 (Lots 1-7 and Outlot A), a subdivision located northeast of 179t11 and Burke Streets. The First Amendment to the Subdivision Agreement provides for Watershed Management Fees currently estimated in the amount of$64,840.00 to be paid as building permits are issued. The First Amendment to the Subdivision Agreement covers the use, ownership, and maintenance responsibilities of the outlot. The Public Works Department requests your consideration and approval of the attached Resolution and First Amendment to the Subdivision Agreement. Curtiss ate Mayor's Office Date fp Finance Director P:Arah\I235rah.doc FIRST AMENDMENT TO SUBDIVISION AGREEMENT WEST VILLAGE POINTE REPLAT 8 (LOTS 1-7 AND OUTLOT A) ��I1 / THIS IRST AMEN ENT TO SUBDIVISION AGREEMENT, made and entered into this (1 4.4.day of , 2014, among, VILLAGE WEST LLC, a Nebraska Limited Liability Company (the "Subdivid r"), SANITARY AND IMPROVEMENT DISTRICT No. 483 OF DOUGLAS COUNTY, NEBRASKA (the "District"), and WEST VILLAGE POINTE BUSINESS ASSOCIATION, a Nebraska non- profit corporation ( the "Association"), and the CITY OF OMAHA, NEBRASKA, a Municipal Corporation of the State of Nebraska (the "City"). WITNESSETH WHEREAS, Subdivider is the owner of the land included with the proposed plat attached hereto as Exhibit "A-1", which parcel of land (hereinafter referred to as the "Area to be Developed") is outside the corporate limits of the City, but within the City's zoning and platting jurisdiction; and, WHEREAS, the City, Subdivider, District, and Association entered into a Subdivision Agreement, approved by the City Council of the City of Omaha by Resolution No. 893 on July 27, 2004. The Parties desire to amend the Agreement pursuant to the Omaha Master Plan and Chapter 55, Omaha Municipal Code as more particularly described in this First Amendment. WHEREAS, the Subdivider is the record owner of and proposes to replat Lots 4, 5, 6, 7, 8, 11,12 and Outlot A, West Village Pointe Replat 5 into Lots 1,2,3,4,5,6,and 7 and Outlot "A", West Village Pointe Replat 8, a copy of which Replat 8 is attached and incorporated herein as Exhibit "A-1". NOW, THEREFORE, IT IS AGREED AS FOLLOWS: 1. Exhibit"A" entitled "Final Plat" (Exhibit "A" of the Agreement), is hereby revised to include Exhibit "A- 1" of this Amendment attached hereto.. 2. The following paragraphs are hereby added to and made a part of Section IX of the Agreement: H. The owner of each of the following lots shall make payment to the City of Omaha for Watershed Management Fees. This fee is computed as follows for the lots shown on Replat 8 (Exhibit "I" to this First Amendment). Payment shall be made to the City Permits and Inspections Division prior to receiving a building permit to construct improvements on any of such lots. Payment shall be based on the then-current fee on the date of the building permit application, as adopted by the Omaha City Council. For example, for FY2014, the fee would be as follows: Lot 1,West Village Pointe Replat 8, 4.593 Acres @ $4,387.00/ac. $20,149 Lot 2, West Village Pointe Replat 8, 1.177 Acres @ $4,387.00/ac. $ 5,163 Lot 3, West Village Pointe Replat 8, 2.607 Acres @ $4,387.00/ac. $11,437 Lot 4, West Village Pointe Replat 8, 1.668 Acres @ $4,387.00/ac. $ 7,318 Lot 5, West Village Pointe Replat 8, 1.824 Acres @ $4,387.00/ac. $ 8,002 Lot 6, West Village Pointe Replat 8 1.584 Acres @ $4,387.00/ac. $ 6,949 Lot 7,West Village Pointe Replat 8 1.327 Acres @$4,387.00/ac. $ 5,822 TOTAL: $64,840 1. In the event the Subdivider shall plat additional lots within the District, the Agreement, as amended, shall be further amended by the Parties to provide payment of the current fee for such additional lots before any building permits are issued by the City with respect to such additional lots. J. The District and the City agree that payment made under Section IX-H of the Agreement shall constitute a Watershed Management Fee for the lots described in Section IX-H and shall be collected by the City as a Watershed Management Fee or shall be levied as a Special Assessment against the lots described in Section IX-H as follows: 1. Each of the lots described in Section IX-H shall be charged the Watershed Management Fee amount as set forth in Section IX-H. 2. The Watershed Management Fee for any such lot shall be collected by the City from the owner of each such lot or levied as a Special Assessment in the amount as shown in Section IX-H either before or at the time any building permit is issued with respect to any such lot. 3. In the event of annexation by the City, the Watershed Management Fee shall continue to remain as a special assessment or charge against each lot within Replat 8 for which such Watershed Management Fee has not been previously paid. 3. The following paragraph is hereby added to and made a part of Section X of the Agreement: J. Outlot A, West Village Pointe Replat 8, shall be shall be owned and maintained by the Association, and shall be used for a private street open for public access. This First Amendment to the Subdivision Agreement shall be binding upon the parties, their respective successors and assigns and shall run with the land as shown on Exhibit"A-1". Except as modified by this First Amendment, the Agreement shall remain in full force and effect. IN WITNESS WHEREOF, the executing parties, by their respective duly authorized agents, have entered into this First Amendment to the Subdivision Agreement effective the date of City Council approval. Resolution By Res. that, the Amendment to the Subdivision Agreement among the City of Omaha, Village West LLC,a Nebraska Limited Liability Company, West Village Pointe Business Association, a Nebraska non-profit corporation,and Sanitary and Improvement District No.483 of Douglas County, Nebraska, as recommended by the Mayor, providing for the Watershed Management fees and the use, ownership, and maintenance responsibilities of the outlot, is hereby approved.
