The attached resolution approves the contract with Mark VII Enterprises for OPW 52634-SP,
being Roanoke Estates Park Pool ADA Improvements located at 4747 North 113th Street.
The following bids were received on August 27, 2014. A detailed bid tabulation is attached.
Contractor Total Bid
Fauss Construction, Inc. $134,900.00 (Non-Compliant Bid)
MARK VII ENTERPRISES $178,000.00 (RECOMMENDED BID)
Rife Construction $191,235.00
The bid received from Fauss Construction, Inc. Services was non-compliant as defined by the
Small Emerging Business Ordinance.
The contractor has a current Contract Compliance Report Form (CC-1) on file. As is City
policy, the Human Rights and Relations Department will review the contractor to ensure
compliance with the Contract Compliance Ordinance.
The Finance Department is authorized to pay the cost of OPW 52634-SP from the 2010 Public
Facilities Bond Fund 13245, Public Facilities Bond Organization 117515, year 2014
expenditures.
The Public Works Department recommends the acceptance of the bid from Mark VII Enterprises
in the amount of $178,000.00, being the lowest and best bid received, and requests your
consideration and approval of this resolution.

RE: Bids for Project OPW 52634
Dear Bidder:
Section 10-110 of the Omaha Municipal Code allows a Departmental Director to reject bids
because items on the bid received were non-compliant with the specifications. This letter is to
serve as written notice that your bid for Project OPW 52634, being the Roanoake Estates Park
Pool ADA Improvements project was not compliant with the Small & Emerging Small Business
requirements and has therefore been rejected.
Section 10-200.3(f) states: "If the public works department and the architect/design professional
designing the project determine that the project or portions of the project are appropriate for
small or emerging small businesses either as a prime contractor or a subcontractor, then such
determinations shall be made a part of the bid specifications, and the bidders not adhering to the
requirements set forth in the bid specifications will be deemed non-responsive." Furthermore,
Section 10-200.4(a) states: "All bidders shall complete the requisite forms in the bid documents
listing all certified small or emerging small businesses subcontractors to be utilized on the
project. Documentation must be submitted at the time the bid is opened." In the review of your
bid, it was determined that the firm you identified, Tyrice Painting, to meet reserve specifications
was not certified at the time of bid opening. Tyrice Painting's certification expired on 5-12-13.
Section 10-110 also provides that: "Within ten (10) days after a bid is rejected, any rejected
bidder may appeal to the city council by filing with the city clerk a written objection stating all
the reasons for the objection."

WHEREAS, Mark VII Enterprises submitted a bid of$178,000.00, being the lowest and

NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF OMAHA:
