Jean Stothert,Mayor A` °�{ C Ll s r(F Public Works Director Honorable President and Members of the City Council, Transmitted herewith is a resolution accepting and concurring with a bid award by the State of Nebraska Department of Roads (NDOR) for the reconstruction of the North 96th Street Bridge, about 2,000 feet north of Rainwood Road, known as OPW 51160, which is the 2014-2019 Capital Improvements Program Transportation Project 401. The City Council approved a Program Agreement with NDOR by Council Resolution No. 418 on March 27, 2012 for BRO-7028(47), State Control No. 22235, which involves replacement of the existing bridge structure as identified in the approved Program Agreement. NDOR received bids for this project on October 23, 2014 and has awarded the project to the lowest bidder, M. E. Collins Contracting Company, Inc., Wahoo, Nebraska, in the amount of $389,946.47. The majority of the eligible costs of this State-sponsored project are covered by Federal funds, with Omaha's participating share to be $77,989.29. This cost is to be paid from the 2010 Transportation Bond Fund 13183, Organization 117117, in accord with the approved program agreement with NDOR for the project. M. E. Collins Contracting Company, Inc. has filed the required Contract Compliance Report, Form CC-1, in the Human Rights and Relations Department. The bridge crosses over an unnamed stream that leads into Cunningham Lake. The bridge is located at 41 miles, 21' 06.00" N and 96 miles 03'24.00'W , and WHEREAS, in the above agreement, the City has pledged sufficient funds to finance its share of the cost of the construction of this project identified as BRO-7028(47) and WHEREAS, the above mentioned agreement provided that the City would pay costs as set forth in the agreement, and WHEREAS, the State and the City received bids for the construction of this project on October 23 2014 , at which time 3 bids were received for the construction of the proposed work, and WHEREAS, the following contractor(s) for the items of work listed has/have been selected as the low bidder(s) to whom the contract(s) should be awarded: M. E. Collins Contracting Company, Inc., Wahoo, NE Grading, Culverts, Landscaping, Bituminous, General Items: $389,946.47 NOW THEREFORE, in consideration of the above facts, the City Council of the City of Omaha by this resolution, takes the following official action: 1. If for any reason the Federal Highway Administration rescinds, limits its obligations, or defers payment of the Federal share of the cost of this project, the City hereby agrees to provide the necessary funds to pay for all costs incurred until and in the event such Federal funds are allowed and paid. 2. The Council hereby concurs in the selection of the above mentioned contractor(s) for the items of work listed, to whom the contract(s) should be awarded. 3.
